FF AN ORDINANCE VACATING THAT PART OF FLAMER AVENUE SOUTH OF A LINE CONNECTING THE SOUTHERLY BOUNDARIES OF LOTS 13 AND 30, EDGEWATER ACRES, BEING A SUBDI- VISION IN THE CITY OF EDGEWATER, FLORIDA, AS PER MAP IN MAP BOOR 11, PAGE 299, PUBLIC RECORDS OF VOLUSIA COMM, FLORIDA, AND PROVIDING POR THE REVERSION OF THE ABANDONED PORTIONS OF SAID FLAGLER AVENUE TO THE ABUTTING PROPERTY OWNERS. ADOPTED WHEREAS, the City Council of the City of Edgewater, Florida did on the loth day of May, 1954 pass a resolution entitled as follows, to -wit: "A resolu- tion declaring the intention of the City of Edgewater, Volusia County, Florida to vacate that part of Flagler Avenue south of a line connecting the southerly boundaries of Lots 13 and 30, Edgewater Acres, being a subdivision in the City of Edgewater, Florida, as per map in Map Book 11, page 299, Public Records of Volusia County, Florida, and providing for the service of notice upon abutting property owners and the time and place at which objections can be heard before the City Council", and WHEREAS, in accordance with the aforesaid resolution all of the abutting property owners on certain parts of Flagler Avenue in the City of Edgewater were personally served with true copies of said resolution as provided for by said resolution, and WHEREAS, a hearing was held by the City Council of the City of Edgewater, Florida at the City Hall, Edgewater, Florida on June 14, 1954 at 7:30 P. M. as provided for by said resolution for the purpose of hearing objections to the vaca- tion of certain parts of Flagler Avenue, and WHEREAS, the best interests of the City of Edgewater, the public and the abutting property owners can be served by vacating certain parts of Flagler Avenue. FLORIDA: NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, Section 1: Flagler Avenue south of a line connecting the southerly boundaries of Lots 13 and 30, Edgewater Acres, being a subdivision in the City =y 66 w a Y W d coo (T n - of Edgewater, Florida, as per nap in Map Book 11, page 299, Public Records of Y4olusia County, Florida, is hereby. vacated. 0Dm'm do Section 2: The afore -described portions of Flagler Avenue which are hereby vacated and abandoned shall revert to the abutting property owners as provided by operation of law. Section 3: This ordinance is enacted pursuant to the provisions of Section 112, Chapter 27532, Laws of Florida 1951. Section That all ordinances or parts of ordinances in conflict here- with be, and the same are, hereby repealed. Section 5: This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by the vote of the City Council of the City of Edgewater, Florida at a regular meeting held on the 14th day of June, A. D. 1954. Upon motion duly made, seconded and carried the requirement of reading said ordinance upon second reading was waived, and the ordinance was ordered put upon final passage. Passed by the vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council heldon the 14th day of June, A.
