323ORDINANCE NO. 323 AN ORDINANCE ABANDONING SPENCER STREET, # M. A. SNIDER'S SUBDIVISION, EDGEWATER, Ix FLORIDA, AS PER MAP THEREOF IN MAP BOOK 8, N m PAGE 26, PUBLIC RECORDS OF VOLUSIA COUNTY, AD�PD o 2 00 FLORIDA, WITH A REVERTER CLAUSE. �N0�O 'MCL BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: Section 1: This Ordinance is enacted pursuant to Section 112 of Chapter 27532, Laws of 1951, the same being the Legislative Charter of the City of Edgewater. Section 2: Spencer Street lying between Blocks 2 and 3 of M. A. Snider's Subdivision as per map in Map Book 8, page 26, Public Records of Volusia County, Florida, a 40 foot street abutting block 2 of said M. A. Snider's Subdivision as per map in Map Book 8, page 26, Public Records of Volusia County, Florida, be and the same is hereby abandoned. Section 3: The Mayor and City Clerk be and they are hereby directed to give to Joe Weiss and Mildred Weiss, his wife, the abutting property owners, a quit -claim deed from the City of Edgewater for the property covered by this Ordinance, with the stipulation that said property covered by this Ordinance shall revert to the City of Edgewater, Florida, if and when the abutting property ceases to be used as a trailer park. Section 4: Joe Weiss and Mildred Weiss, his wife, as the owners of Lots 1 through 7, Block 2, M. A. Snider's Subdivision, as per map in Map Book 8, page 26, Public Records of Volusia County, Florida, have waived service of notice upon them as provided by Section 112 of the Legislative Charter of the City of Edgewater. Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage.
