544P ORDINANCE NO. 544 cMID AN ORDINANCE APPROVING THE RECOMMENDATIONS OF THE EDGEWATER ZONING BOARD AND GRANTING THE REQUEST # OF REVEREND WILLIAM J. RICHARDS AND MARGARET RICHARDS TO RE -ZONE LOTS 482, 483, and 484, HAWKS o O PARK SUBDIVISION IN THE CITY OF EDGEWATER, FLORIDA O(G WHEREAS, pursuant to applicable ordinances of the City of Edgewater, Florida, the Edgewater Zoning Board did on April 14, 1967 hold a public hearing upon the application of Reverend William J. Richards and Margaret Richards to re -zone Lots 482, 483 and 484, Hawks Park Subdivision of the City of Edgewater, Volusia County, Florida, from residential to commercial, and WHEREAS, the said request was presented for the purpose of facilitating the sale of the said property for cemetery purposes and WHEREAS, the said Edgewater Zoning Board did place certain restrictions upon their recommendation that the said property be re -zoned from residential to commercial,and WHEREAS, the City Council has approved the said findings and recommendations of the Edgewater Zoning Board together with its provisions and conditions. NOW THEREFORE BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That the findings and recommendations of the Edgewater Zoning Board relative to the re -zoning of Lots 482, 483, and 484, Hawks Park Subdivision in the City of Edgewater, Volusia County, Florida be and the same are hereby approved and the said land be and the same is hereby re -zoned from residential to commercial upon the following conditions: (a) That the said land is to be used only for cemetery purposes. (b) That a road or drive be constructed at the sole cost of Reverend William J. Richards and Margaret Richards or their heirs, successors and assigns in title, said road to be at least syy i w 0 Y /fyWY�1(� d W�YL1 �� V f�11 V L'OY Y C YU1Eo 0Dm'm 00FEI= 25 feet in width and to be constructed and maintained and laid out on the west side of Lot 482 and run the entire length north and south of said Lot 482 and parallel to and just east of the existing mosquito control canal and said construction shall be within six months after the adoption of this ordinance. (c) That no building or part of any building is to be constructed or placed on Lots 482, 483 and 484 as above referred to. In event of default in any of the above conditions, the land shall revert to the prior residential zoning classification and that any persons then in violation of the said zoning ordinances shall be liable to the penalties prescribed thereunder. Section 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. That this ordinance shall take effect immediately upon its passage and approval by the Vice Mayor. The above ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida at a special meeting of said Council held on April 21, 1967. Upon motion duly made, seconded and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage.
