ORDINANCE NO. 2000-0-06
AN ORDINANCE OF THE CITY COUNCIL OF
EDGEWATER, FLORIDA; TO CREATE AND ENACT
CHAPTER 21 (FIRE DEPARTMENT), ARTICLE I (IN
GENERAL), SECTION 21-1 (SHORT TITLE), SECTION 21-2
(FIRE DEPARTMENT), ARTICLE II (REIMBURSEMENT),
SECTION 21-3 (STANDBY COSTS FOR PERSONNEL AND
EQUIPMENT); OF THE CODE OF ORDINANCES, CITY OF
EDGEW A TER, FLORIDA; PROVIDING FOR CONFLICTING
PROVISIONS, SEVERABILITY AND APPLICABILITY;
PROVIDING FOR CODIFICATION, AN EFFECTIVE DATE
AND FOR ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. Upon research, the City has learned that the current Article IV (Fire Department) of
Chapter 13 (Personnel) ofthe Code which relates to the Fire Department has not been modified since
1983 and is therefore obsolete.
2. Article VI (Burning of Garbage, Trash, Brush, etc) of Chapter 10 (Health and
Sanitation) was enacted during emergency (wildfire) conditions and will be incorporated into the
new Land Development Code for consistency.
3. In an effort to preserve the safety of our residents, it would be in the best interests of
the citizens of Edgewater to enact a new Chapter relating to the Fire Department in the City of
Edgewater Code of Ordinances.
4. Chapter 21 (Fire Department) will be consistent with City policies and standards
currently recognized as State and National Recommendations.
NOW, THEREFORE, BE IT ENACTED by the People of the City of Edge water, Florida:

CREATION OF CHAPTER 21 (FIRE DEPARTMENT), ARTICLE I
(IN GENERAL), SECTION 21-1 (SHORT TITLE), SECTION 21-2
(FIRE DEP ARTMENT), ARTICLE II (REIMBURSEMENT),
SECTION 21-3 (STANDBY COSTS FOR PERSONNEL AND
EQUIPMENT); OF THE CODE OF ORDINANCES, CITY OF
EDGEWATER, FLORIDA, IN ITS ENTIRETY.
Chapter 21 (Fire Department) is hereby created as follows:
Sec. 21-1.
ARTICLE I. IN GENERAL
Short title.
This chapter shall be referred to as the "Fire Department" Ordinance of the City of
Edgewater, Florida".

Fire Department.
Comvosition. The City shall have a combination paid/volunteer Fire-Rescue
Department that shall consist of a Chief and such other number of firefighters as
determined by City policy. The Fire Chief shall be the department director and be
appointed and removed by the City Manager. The Fire Chief and firefighters shall
receive compensation as determined by city policy.
Duties of Fire Chief All rules and regulations issued by the state fire marshal under
authority of Chapter 633.121, Florida Statutes, shall be enforceable by the Chief of
the Fire-Rescue Department. The Chief is hereby authorized to perform within any
areas of City iurisdiction any duties that may be imposed upon the Chief by such law
or in accordance therewith, and to have such assistance as the Chief may find
necessary from other officials of the City in the discharge of such duties.
ARTICLE II. REIMBURSEMENT
Standby costs for personnel and equipment.
The Fire Chief or his/her designee may require apparatus and/or fire-rescue personnel to
standby until a hazardous or dangerous condition is remedied. Any and all costs for such standby
apparatus will be billed to the property owner in accordance with the most recent FEMA equipment
fee schedule rate. Any and all costs for career personnel will be billed to the property owner at rates
in accordance with the Edgewater Personnel Policy and Procedure Manual.

PART B.
CODIFICATION.
Provision of this ordinance shall be incorporated in the Code of Ordinances of the City of
Edgewater, Florida, and the word "ordinance", may be changed to "section", "article", or other
appropriate word, and the sections ofthis ordinance may be renumbered or relettered to accomplish
such intention; provided, however, that Parts B through F shall not be codified.
PART C.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance,
are hereby superseded by this ordinance to the extent of such conflict.
PARTD.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or
circumstance, such holding shall not affect its applicability to any other person, property, or
circumstance.
PART E.
EFFECTIVE DATE.
This ordinance shall take effect upon adoption.
