86-O-20a ORDINANCE NO. 86-0-20 M AN ORDINANCE OF THE CITY COUNCIL OF THE CITY o OF EDGEWATER, FLORIDA, ANNEXING CERTAIN REAL �cv m PROPERTY TO THE CITY OF EDGEWATER, FLORIDA, ss LOCATED AT SECTION 1, TOWNSHIP 18 SOUTH, RANGE 34 EAST, AND SECTION 12, TOWNSHIP 18 SOUTH, o Y RANGE 34 EAST, PURSUANT TO FLORIDA STATUTES, c 0 SEC. 171.044; REDEFINING THE BOUNDARIES OF THE N oft CITY OF EDGEWATER, FLORIDA; BY AMENDING THE H APPROPRIATE SECTIONS OF THE CODE OF ORDINANCES; PROVIDING THAT UPON ADOPTION CERTIFIED COPIES BE FILED WITH THE CLERK OF THE COURT IN VOLUSIA COUNTY, THE DEPARTMENT OF STATE AND THE CHARTER REVIEW DEPARTMENT; CONTAINING A REPEALER PRO- VISION, A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The Radnor Corporation is the owner in fee simple of certain real Property located in Volusia County, more particularly described below, and WHEREAS, The Radnor Corporation has petitioned the City of Edgewater for voluntary annexation under Florida Statute 171.044, and WHEREAS, at a meeting of the Planning and Zoning Board on the 17th day of July , 1986, the Planning and Zoning Board reviewed said Petition and recommended that said property be annexed into the City Limits under the MH-2 Mobile Home Subdivision District and B-3 Highway Service Business District. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. The following described parcel of land lying and being in the County of Volusia, and contiguous to the boundary lines of the City of Edgewater, is hereby, pursuant to Section 171.044, Florida Statutes, annexed and made part of the City of Edgewater, Florida, and shall be subject to the jurisdiction, obligations, benefits and privileges of the municipality, to wit: See Appendix "A", attached hereto and by reference incorporated herein with full force and effect as if herein set forth. SECTION 2. The following described parcel of land lying and being in the County of Volusia, and contiguous to the boundary lines of the City of Edgewater, is hereby, purdudnt to Section 171.044, Florida Statutes, annexed and made part of the NO z m,� Pn �f m City of Edgewater, Florida, and shall be subject to the jurisdiction, obligations, benefits and privileges of the municipality, to Y (a 00 010 wit: MEL See Appendix "B", attached hereto and by reference incorporated herein with full force and effect as if herein set forth. SECTION 3. The boundaries of the City of Edgewater are hereby changed and redefined so as to include the land described in Sections 1 and 2 above in accordance with the legal descriptions attached hereto and made a part hereof. (See Appendix "A" and "B") SECTION 4. That upon adoption of this ordinance, the appropriate Sections of the Code of Ordinances of the City of Edgewater, shall be amended by redefining the boundaries of the City to include the lands described in Sections 1 and 2 above. SECTION 5. That the. City Clerk is hereby directed to advertise this ordinance once a week for four consecutive weeks in a newspaper of general circulation setting a date for a public hearing and final adoption. SECTION 6. That upon adoption of this ordinance, certified copies shall be filed with the Clerk of the Circuit Court in and for Volusia County, the Department of State in Tallahassee and the Charter Revision Department of the State within 30 days. SECTION 7. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION S. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. -2- Ord. 86-0-20 CZ OF p4zf COCJ SECTION 9.
