82-O-26ORDINANCE 82-0-26 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, ADOPTING A NEW OFFICIAL ZONING MAP FOR THE CITY OF EDGEWATER, FLORIDA; AUTHORIZING THE MAYOR TO IDENTIFY THE MAP AS THE OFFICIAL ZONING MAP BY SIGNING HIS NAME THERETO; DIRECTING THAT THE SEAL OF THE CITY BE PLACED UPON THE OFFICIAL ZONING MAP; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is necessary that there be an official zoning map of the City of Edgewater, Florida; and WHEREAS, the official zoning map as it presently exists is difficult to interpret because of the nature of changes and additions thereto; and WHEREAS, The City Council is authorized by Section 501.04- of the Zoning Ordinance of the City of Edgewater, Florida, to adopt a new official zoning map when the map as it presently exists is too difficult to interpret because of the nature or number of changes and additions thereto, NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the zoning map as attached hereto and made a part hereof is hereby adopter} as the Official Zoning Map of the City of Edgewater, Florida. SECTION 2. That the Mayor of the City of Edgewater, Florida, is hereby authorized and directed to place his signature upon said zoning map identifying it as the Official Zoning Map of the City of Edgewater, Florida. SECTION 3. That said zoning map as signed by the Mayor shall bear the seal of the City of Edgewater, Florida, and shall also bear the following words: "This is to certify that this Official Zoning Map supersedes and replaces the Official Zoning Map adopted iJCU, a7,19?8 as part of Ordinance No. 219, of the City of Edgewater, Florida." SECTION 4. That this new official zoning map shall supersede the prior official zoning map. SECTION 5. That the City Clerk shall advertise this Ordinance as provided by law. V SECTION 6. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 7. That this Ordinance shall take effect immediately upon adoption as provided by law. The Ordinance was read for a first time by title and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting thereof held on the R day of July, 1982. On May 21, 1979, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 79-0-12 rezoning the Mike Caldwell property from Resort -Residential Planned Unit Development(RR-PUD) to R-1. On June 11, 1979, by official action of the City Council, the following changeswere made in the Official Zoning Map: Ordinance 79-0-17 rezoning the Seahorse Trailer Park from B-3 and R-3 to MH-lA. On July 9, 1979, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 79-0-21 changing zoning classification B-1, Central Business District, to B-3, Highway Service District. On November 26, 1979, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 79-0-34 annexing certain real property owned by John W. Rowley Ten (10) acres described as the West 1/4 of the Northwest 1/4 of the Southeast 1/4 of Section 2, Township 18 South, Range 34 East. On January 28, 1980, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 79-0-39 creating a special mobile home zoning district Known as "Mobile Home -Special" (MH-S) for non -conforming mobile home parks Anchor Garage Trailers, Blue Gables Trailer Park, Carter's Trailer Park, Edgewater Mobile Home Park, Friendly Shores, Pyramid Mobile Park, Riverview Pines and Wolfe's Driftwood Village. Ordinance 79-0-40 rezoning the B-5 Planned Shopping Center District bounded North by South right of way of Pearl Street, bounded South by North right of way of Park Avenue, bounded West by Easterly right of way of Old County Road and bounded East by Westerly right of way U.S. #1 to B-3 Highway Service Business District. On February 11, 1980, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 80-0-41 rezoning the Douglas Cole property and I-1 Westerly 240 ft. of Southerly 495 ft. of U.S Lot 4, Section 3, Township 18 South, Range 34 East Multi -family District. 11 City 0 -2- ZONING MAP AMENDMENTS (Continued) On February 25, 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-42 vacating one hundred sixty feet of that certain fifteen foot alleyway, lying north of Indian River Blvd, contiguous to Lot 433, 434, 435 and 436, inclusive, in Block 16, Florida Shores Unit No. 1, between Fern Palm Drive and Guava Drive. On April 7, 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-45 redesignating all R-3B Zoning Districts to R-2B Zoning Districts. On May 12, 1980, by official action of the City Council the following changes were made in the official Zoning Map: JOrdinance 80-0-53 rezoning the South 330 feet of U.S. Lot 4, Section 3, Township 18 South, Range 34 East, lying West of the West right-of-way of the Florida East Coast Railroad from / FPL into the I-1 Light Industrial District. On May 19; 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-54 rezoning certain parcels of property known as "Cemetery", "Edgewater Public School" and "Church" into the R-4 Multi -family District. On June 9, 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-57 vacating a portion of Fourteenth Street, lying between 2131, Block 48, and Lot 2130, Block 47, Florida Shores Subdivision No. 4. On June 16, 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-60 rezoning Lots A 5 B of Wildwood Subdivision, Unit 1, part of U.S. Lot 4, Section 32, Township 17 South, Range 34 East, part of J.A. Benoit's Subdivision belonging to Frank Hall from R-2A to B-2. On July 14, 1980, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 80-0-62 vacating a fifty foot right-of-way located at the end of Evergreen Drive, between Block 10, Lots 254 and 255, and Block 13, Lots 315 thru 318, Florida Shores, Unit No. 1. On March 23, 1981, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 81-0-7 rezoning the East by the west right of way of the Florida East Coast Railroad's main line, boundecl op the North by the City limits, on the West by the Western city limits, on the South by a line 350 feet North of and,measureo perpendicular to the North right of way of Park Avenile, sl.inning to the Westerly right of Way of Mango Tree Drive asiprolonyated North of Park Avenue from I-3 to PID. Grady as Bishop of the Diocese of Orlando containing 50.48 acres of Section 2, Township 18 South, Range 34 East. On February 1, 1982, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 81-0-46 rezoning Lots 564-566; 628-630; 3155-3183; 6999-7014; 71 5-7130 of the Florida Shores Subdivision from R-lB and R-2B to R-4. On March 1, 1982, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 82-0-4 rezoning Lots 1-18 and Lots 25-40 Florida Shores Subdivision Unit 1 from R-IB to B-5. On April 5, 1982, by official action of the City Council the following changes were made in.the Official Zoning Map: Ordinance 82-0-6 annexing real property owned by James C. Carder and Rosemary Carder containing approximately 54 acres, South § of Lot 11; Lots 12, 13, 14, 17, 18 and 19 of Edgewater Country Club Estates conditionally as R-4. On April 5, 1982, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 82-0-9 rezoning Lots 25 through 29, Block E, Highland Shores Section 1 and Lot 20 Assessor's Subdivision of Shepperd and Sanchez Grant from R-3 and I-1 to R-4. On May 3, 1982, by official action of the City Council the following changes were made in the Official Zoning Map: Ordinance 82-0-14 vacating 150 feet of Alvarez Lane west of Hubbell (Plaza Lane). -4- ZONING MAP AMENDMENTS (Continued) On September 20, 1982, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 82-0-28 rezoning Lots 3-10, Block 1, Fuller and Settle Subdivision, from B6 to B3. On November 7, 1983, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 83-0-17 vacating ten feet of utility and drainage easements between Lots 132 and 133 and Lots 133 and 134, respectively, of Wildwood Subdivision, Unit 3. On February 20, 1984, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 83-0-26 rezoning the east 886.7 feet on the South line of the West 1754 feet of Lot 37, Assessor's Subdivision of the Alvarez Grant from MH1 to MH2. On March 19, 1984, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 84-0-2 vacating a portion of the road known as T a tran ", north of Sanchez Avenue and Palmetto Park Subdivision. On October 1, 1984, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 84-0-11 rezoning Lots 1, 2, 11, 12, 13, 14 and 15 located south of Park Avenue between Old County Road and Highway No. 1, from B6 to B3. On November 19, 1984, by official action of the City Countil, the following changes were made in the Official Zoning Map: Ordinance 84-0-18 annexing property north of Rankin Drive and East of U.S. Highway No. 1, consisting of approximately 20.20 acres. Ordinance 84-0-19 zonngg property annexed by Ordinance -0-1 from County B4/R3 to Edgewater R1. On November 5, 1984, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 84-0-21 rezoning Parcel 2 between Alamanda Drive and Indian River Boulevard from B6 to B3. On January 7, 1985, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 84-0-32 rezoning a portion of property on Marion Street from B2 to I2. On February 18, 1985, by official action of the City Council, the following changes were made in the Official Zoning Map: Ordinance 85-0-2 rezoning Lots 5, 6, 7, 8, 9, Block 2, Resub in River Edge Acres located on Lincoln Road, from R1 to R2.
