82-O-22'to ., 0 -fib" ORDINANCE NO. 82-0-22 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, AMENDING SECTION 19-41 OF THE EDGEWATER CODE OF ORDINANCES TO PROVIDE FOR AN INCREASE IN DEVELOPMENT FEES CHARGED TO NEW USERS OF THE WATER AND WASTE WATER SYSTEM FROM $200.00 TO $400.00 FOR WATER AND $400.00 FOR SEWERAGE, REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City Council has authorized an engineering study concerning the justification for water and sewer development fees, and WHEREAS, The report of the consulting engineers, using models and scales, demonstrated that the development fee schedule was inadequate to meet the need of expanding the water and waste water system, and WHEREAS, The report showed that the development fee schedule could be raised as high as $600 for both water and sewerage, NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: That Section 19-41 of the Edgewater Code of Ordinances is hereby amended to read: Sec. 19-41 FEE SCHEDULE There is hereby imposed a development fee based on the city council's determination of the equitable portion of the cost of financing the extension of the system upon the equivalent living unit responsible for the need for additional system financing. The fees shall be as follows: (a) For each equivalent living unit connected to the system: Water service development fee $400.00 Sewer service development fee 400.00 Total for both services B00.00 (b) For each equivalent living unit constructed in areas served by privately owned water distribution systems using the city water supply only: Water service development fee $400.00 0 (c) For each equivalent living unit with prior water service connected to the sewer collection system only: Sewer service development fee $400.00 Each additional equivalent living unit occasioned by changes in property usage subsequent to the effective date of this article shall be subject to a development fee computed in accordance with the foregoing criteria. That this ordinance shall take effect immediatetly upon adoption as provided by law.
