82-O-20ADOPTED /� ORDINANCE NO. 82-0-10 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA AMENDING ORDINANCE 82-0-18A, WHICH CALLED FOR A SPECIAL ELECTION FOR THE SUBMISSION OF THREE QUESTIONS TO THE ELECTORS OF THE CITY OF EDGE - WATER, FLORIDA, RELATING TO A NEW HOME RULE CHARTER, TOGETHER WITH TWO PROPOSED OPTIONS, nRj BY AMENDING SAID ORDINANCE TO INCLUDE OPTION a WITHIN THE BODY OF THE PROPOSED HOME RULE CHARTER FURTHER PROVIDING THAT OPTION A SHALL BE A SEP- ARATE QUESTION UPON THE BALLOT; FURTHER PROVIDING FOR THE AMENDMENT OF QUESTIONS UPON THE BALLOT TO REFLECT SAID CHANGES: FURTHER PROVIDING FOR THE INCLUSION OF THE CHANGES WITHIN THE TEXT OF THE PROPOSED CHARTER; AND INCORPORATING SAME BY REFERENCE THEREIN; CALLING FOR A SPECIAL ELECTION ON JULY 13, 1982, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The City Council adopted Ordinance 82-0-18A, calling for a special referendum election for July 13, 1982, for the purpose of submitting to the electors of the city of edg- ewater, Florida a New Home Rule Charter together with two options regarding the selection of the Mayor and City Council, and WHEREAS, The Ordinance, as aforesaid, directed that the election was to be under the supervision of the Volusia County Supervisor of Elections, and WHEREAS, The Supervisor of Elections has determined that it is physically impossible to submit options to electors co- ncerning the selection of a mayor and council, because of the formatting of the voting machine, and WHEREAS, The Council has determined that the question commonly known as Option B is the present system of election of council members and the mayor, and WHEREAS, The Council has determined that including Option B within the text of the New Home Rule Charter would not effect the intent of providing the electors a clear choice on the election of the council and mayor, WHEREAS, The council deems this to be an emergency ord- inance in order to clarify the ballot questions in time for advertising prior to the July 13, 1962 special election, NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Section 2 of Ordinance 82-0-18A is hereby amended to read: That the following questions shall be presented to the electors of the City of Edgewater, Florida for the purpose of approving amendments to the Charter of the City of Edgewater, Florida, to -wit: QUESTION 1. New Home Rule Charter Shall all sections of the Charter Laws of the City of Edgewater, except that part describing boundaries, be amended by the New Home Rule Charter recommended by the Charter Review Commission providing for the creation and powers of the muni- cipality, a Legislative Branch consisting of a four zone council and mayor, and Administrative Branch, a Merit System for perso- nnel, a districting commission, conflict of interest prohib- itions, and provisions for elections, amendment by petition and transition? YES - for approval NO - Against approval QUESTION 2. Option for five zone council with mayor Shall the Edgewater City Charter be amended to provide for the at -large election of five(5) City Council members from five (5) zones, for a term of two (2) years, who shall select a Mayor from among its members, election in the event of vacancy and procedure for nomination and election? YES - for approval NO - against approval SECTION 2. That the specific language of the proposed New Home Rule Charter, together with the Optional provision shall be set forth and attached as "Exhibit "A", hereto, and incorporated by reference herein, as if set forth in extenso. SECTION 3. That all other provisions of Ordinance 82-0-18A not otherwise effected shall remain in full force and effect. 9 SECTION 4. That all Ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 5. That this ordinance shall take effect immediatetly upon adoption as provided by law.
