82-O-19ORDINANCE NO. 8 a-O - I 1 AN ORDINANCE AMENDING SECTION 11-2 OF THE EDGE - WATER CODE OF ORDINANCES TO PROVIDE THAT THE BOARD OF ADJUSTMENTS SHALL CONSIDER ALL APPLI- CATIONS FOR HOME OCCUPATIONAL LICENSES INSTEAD OF THE CITY COUNCIL, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECT- IVE DATE. BE IT ENACTED BY THE PEOPLE. OF THE CITY OF EDGEWATER, FLORIDA, that SECTION 1. That Section 11-2 of the Edgewater Code of Ordinances is hereby amended to read: It shall be Anlawful for any person described in Section 11-1 to engage in or manage any business, profession or occupation in the city unless he holds a current occupational license to do so, which license shall be issued by the city clerk after the city clerk, with the concurrence of the building official, has deter- mined that the issuance of said occupational license will he in conformity with the zoning.ordinances of the city, and upon payment of the license tax required therefor. Provided, however, no license for a business relating to the sale, processing, serving or canning of foods, the building to house same being under construction, shall be granted un- til the plans for construction thereof have been approved by the county health department and the city council. Provided further, the applica- tion for licenses for home occupation must be initially approved by the Board of Adjustments and shall be reviewed each year by the Board prior to renewal of said home occupational license. SECTION 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 3. That this Ordinance shall take effect iixwedaal -, The first reading of said Ordinance is read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the day of May, 1982, and approved as provided by law. The second reading of said ordinance to be at a regular meeting of the City Council to be held on the -{-day o£sa 1982.
