ORDINANCE 82-0-13
AN ORDINANCE AMENDING SECTION 718.00 OF THE
EDGEWATER ZONING ORDINANCE TO PERMIT ZERO LOT
LINE RESIDENTIAL SUBDIVISION, PROVIDING THAT
SAME SHALL HAVE THE SAME YARD DIMENSIONS AS
IS REQUIRED IN THE APPLICABLE ZONING ORDINANCE
EXCEPT THE MINIMUM SIDE YARD SHALL BE EITHER
20 FEET OR ZERO; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Zoning and Planning Board has recommended the
adoption of the following ordinance, and
WHEREAS, appropriate public hearings have been held on the
subject,
NOW THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. Section 718.00 of the Edgewater Zoning Ordinance
is created to read:
Section 718.00 Zero lot lines: Zero lot line residential
subdivisions are permitted in the R-4, R-5, R-5A, B-2, B-3, B-4,
B-5, B-6, I-1, I-2, and PID zoning districts; provided, however:
1. The minimum yard shall be same as for the zoning classi-
fication in which the subdivision is located or proposed,
except that the minimum side yard shall be either zero
or a minimum of twenty (20) feet.
2. Where a dwelling unit is located on a lot line but is
not constructed against a common wall of an adjacent
dwelling unit, a legal provision acceptable to the city
shall be made for permanent access to maintain the
exterior portion of the dwelling unit wall along the
zero lot line.
3. Doors or other access openings are prohibited on the zero
lot line side of the dwelling unit.
4. All other requirements of applicable zoning classification
shall be met.
5. All parcels are to be equally divided.
6. Each individual unit on a zero lot line shall maintain
its own septic tank or waste water hookup facilities.
SECTION 2. That all Ordinances or parts of Ordinances
and all Resolutions or parts of Resolutions in. conflict here-
with be and same are hereby repealed.
SECTION 3. That the City Clerk is hereby directed to
advertise this Ordinance as required by law.
SECTION 4. That this Ordinance shall take effect immediately
upon its adoption by the City Council, and authentication as pro-
vided by law.
The first reading of said Ordinance is read in full and passed
by vote of the City Council of the City of Edgewater, Florida, at
a regular meeting of said Council held on the /9 day of
1982, and approved as provided by law.
The second reading of said Ordinance to be at a
meeting of the City Council to be held on the day of
, 1982.
