82-O-10w ORDINANCE 82-0-10 AN ORDINANCE AMENDING _. OBSOLETE SECTION 8 OF THE CITY CHARTER TO REDISTRICT THE CITY INTO FOUR EQUAL ZONES FOR THE PURPOSE OF ELECTING CITY COUNCILMEN; REPEALING ALL OR- DINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 8 of the Charter of the City of Edgewater divides the City into .four voting districts for the purpose of elect- ing four members of the City Council, and WHEREAS, the 1980 census showed that there is a tremendous dis- parity among the four voting districts in terms of population, and WHEREAS, the one man, one vote principle of the equal protection clause of the United States and Florida Constitutions, together with the Voting Rights Act of 1965, mandate that the City of Edgewater re- district prior to the 1982 general elections to be held within the City, for the purpose of insuring that each electoral district is in equal size so that no vote within the City of Edgewater will be of different weight. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That paragraph Three of Section 8 of the Charter of the City of Edgewater, is hereby amended to read: The City is hereby divided into four voting districts as follows: Voting District 1, shall be the area described as: Beginning at the intersection of the center line of the Garbody Canal, or South Canal, and the westerly right-of-way of the intercoastal waterway; thence southerly along the western right-of-way of said intercoastal right-of-way to a point op- posite the center line of Ocean Avenue extended; thence westerly along the center line of Ocean Avenue to the west corporate limits of the City; thence northerly and westerly around the corporate limits of the City returning to the center line of Garbody or South Canal; thence easterly along the center line of said Canal to the point of beginning. Voting District 2, shall be the area described as: Beginning at the point of intersection of the westerly right-of-way line of the intercoastal waterway and the center line of 0 Avenue extended; C.n thence south along the right-of�way of the intercoastal waterway to the intersection with the center line of a certain drainage canal lying northerly of Indian River Boulevard; thence westerly along the center line of said Canal until said Canal merges at its closest point with the center line of 16th Street; thence westerly along the center line of 16th Street until said Street merges with the center line of 17th Street; thence westerly to the western corporate limits of the City; thence in a northerly direction along the corporate limits to the south- ern boundary of District 1; thence easterly along the southern boundary of District 1 to the point of beginning. Voting District 3 shall be the area described as: Beginning at the point of intersection of westerly right-of-way of the intercoastal waterway and the corporate limits of the City adjacent to the northeast corner of the Pelican Cove Subdivision as now laid out; thence west along the corporate borders of the City on the north line of the Pelican Cove Subdivision to U. S. Highway 1; thence across U. S. Highway 1, along the corporate limits of the City to the North side of the Silver Ridge Subdivision, as now laid out; thence west along the northern line of the Silver Ridge Subdivision to the center line of 22nd Street as now laid out; thence south along said 22nd Street to the center line of Guava Drive; thence north along Quava Drive to a point of inter- section of the eastern prolongation of 21st Street; thence west along 21st Street to the corporate limits of the City; thence north along the corporate limits of the City to the south line of Voting District 2; thence east along the south limits of Voting District 2, to the point of beginning. Voting District 4 shall be the area described as: All that area within the corporate limits lying south of the southern boundary of Voting District 3, as previously described. SECTION 2. There shall be an official voting district map which shall be placed in a conspicuous location within City Hall which shall show the voting districts described in this ordinance. A copy of said map is attached hereto and incorporated by reference herein. SECTION 3. That all ordinances or parts of ordinances and all resolutions or parts of. resolutions in conflict herewith be and the same 71 T L J u L_ are hereby repealed.
