82-O-7ORDINANCE NO. AN ORDINANCE AMENDING SECTION 2-.79 PARAGRAPH (b) OF THE EDGEWATER CODE OF ORDINANCES, CHANGING THE RULES OF DEBATE FOR COUNCIL MEMBERS; REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH AND PRO- VIDING AN EFFECTIVE DATE. WHEREAS, the Circuit Court for the Seventh Judicial Circuit of Florida, has denied the Mayor's Petition for Declaratory Relief, there- by ratifying a City Manager form of government for the City of Edge- water and decreeing that the Mayor is merely a presiding officer for Council meetings, and WHEREAS, the Mayor has been ineffective in controlling interrup- tions and disturbances at Council meetings, and has fostered confusion within the meetingq,so that Council meetings have been a source of embarrassment for all our citizens, and WHEREAS, the City Council recognizes that in order to enhance the concept of effective and democratic government, it is essential to preserve docorum and order during legislative meetings as well as promoting the free exchange of ideas among Council members and city management. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Section 2-27 (b) of the Edgewater Code of Ordinances is hereby amended to read: "Getting the floor; improper references, Every member, Mayor, Councilmen, City Attorney, and City Manager, de- siring to speak shall be recognized by the presiding officer first, except that any member, once recognized, may join in a free exchange of ideas and opinions with other members without interruption from the chair. All persons so recognized shall confine themselves to the question under debate, avoding all personalities and indecorous lang- uage, and irrelevant matters." SECTION 2. That all ordinances or parts of ordinances and all Resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. SECTION 3. That this Ordinance shall take effect immediately upon its final passage and authentication as providriby law.
