84-O-36ORDINANCE NO. 84-0-36 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING ARTICLE VII, SECTION 715.02, SITE PLAN APPROVAL, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY DELETING THE PRESENT REQUIREMENTS AND SUBSTITUTING THEREFOR A SITE PLAN REVIEW APPLICATION INFORMATION SHEET; CON- TAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board has reviewed Article VII, Section 715.02 of the Code of Ordinances of the City of Edgewater, Florida, and has recommended specific procedures to be followed for site plan approval at their October 31, 1984 meeting, and WHEREAS, the City Council of the City of Edgewater, Florida, considered these recommendations at their November 5, 1984 regular meeting and authorized the City Attorney to draw up an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Prior to the issuance of a building permit, a site plan must be approved by the Planning and Zoning Board for any activity related to development, building, clearing, subdividing, adding to a building, or changing the use of any land in R4, R5, RSA, R6, Bl, B2, B3, B4,B5, B6, MHI, MH2, MHS, I-1, 1-2, 1-3 and P.I.D. zoned districts; except that single family residences and duplexes shall be exempt from the site plan processes and shall be reviewed by the Building Official for compliance to all zoning codes. The following items shall be included on or with any site plan submitted to the City of Edgewater for review: 1. (1) A location map showing the project location within the City of Edgewater. (2) A boundary survey prepared by a land surveyor registered in the State indicating property dimensions and legal description. (3) The existing and proposed topography shall be shown at one foot intervals, prepared by a land surveyor registered in the State. (4) Any proposed extension of street systems, walks, or entrance ways and all off-street parking areas. The Building Official can provide information on the parking requirements for handicapped persons at commercial buildings. Loading areas are also required for commercial sites in addition to off-street parking. (5) The proposed ingress and egress to all public streets, roads, and highways shall be shown with dimensions. (6) The location and dimensions of all buildings, structures, and other similar improvements shall be shown. (7) Buffers, landscaped areas, and common open space shall be specifically designated. Refer to the Tree Preservation and Protection Ordinance No. 83-0-12, and the Landscape Ordinance No..83-0-14. (8) The proposed method of providing water, sewer, electrical and natural gas (if applicable) utilities services shall be shown. (9) Dimensions and the location of the designated screened garbarge collection area shall be shown where required. 10 An elevation and perspective drawing displaying typical building character shall be submitted. (I1) Location of nearest fire hydrant to proposed site shall be shown on the plan. Il. The City of Edgewater Stormwater Management Permit Application shall also be submitted along with the Site Plan Review Application. Some of the required information is common to both and may be submitted as common project information. -2- Ord. 84-0- 36 However, both application forms must be submitted. Any legal instruments that are required as deed covenants shall also be submitted at the same time. III. Thirteen (13) complete sets of site plan and one (1) set signed and sealed by an architect, registered in the State, must be submitted with the site plan application. Two (2) sets of drainage plans, signed and sealed by an engineer registered in the State must be submitted with the stormwater calculations in addition to the sets required for site plan review. One (I) of the site plan sets will remain in the Planning Office and is designated "Approval Drawing". IV. FEES AND COSTS. Upon application for site plan review, a fee of $75.00 must also be submitted. There is no additional charge for Final Review, should the site plan only receive Pre- liminary Approval. There is no charge for sketch plan review. Any costs incurred by the City from the City Engineer's review of the project will be invoiced and reimbursed by the developer/owner to the City. V. SCHEDULE. (1) Sketch plans shall be submitted no later than 4:30 p.m., one week (7 days) prior to the Planning and Zoning Board Meeting. (2) An application for Site Plan, Single Family or Duplex review shall be submitted no later than 4:30 p.m., three weeks (21 days) prior to the Planning and Zoning Board Meeting. All site plans will be reviewed first by the Department Heads. The Department Head comments will be discussed at a Department Head Meeting that is commonly held two weeks prior to the Planning and Zoning Board Meeting. At the Department Head Meeting, the Department Head will either approve, disapprove, or approve with conditions the site plan. In the week(s) between the Department Head Meeting and the week before the Planning and Zoning Board Meeting, the developer/owner shall address the Department Head's comments in order to obtain Department Head approval. It should be noted that a Department Head approval does not constitute site plan approval. (3) The Planning and Zoning Board will consider the Department Head's review and will use this review only as input in deciding whether to approve or disapprove a site plan. Approval by the Department Head only means that the considerations of that Department have been adequately addressed. (4) If the Planning and Zoning Board gives a preliminary site plan approval to a protect, it is the responsibility of the developer/owner to address the comments or requirements of the Board and request a place on the meeting agenda for consideration for Final Site Plan Approval. A site plan will not automatically be placed on the next meeting agenda after receiving preliminary approval. -3- Ord. 84-0-36 VI. APPROVAL. (1) Sketch Plan Approval. Sketch plan approval implies that the presented con--, ceptual design is feasible with regard to the City Ordinances. After receiving sketch plan approval, the developer must obtain site plan approval before obtaining a building permit. (2) Preliminary Site Plan Approval. A site plan will be given preliminary site Ian approval if the Plannine and Zonine Board determines that the proiect has been properly designed and substantially prepared, based on the information that has been submitted by the applcant and reviewed by the Department Heads, but, there are details that must be provided or contingencies that must be taken care of before final site plan approval can be issued. After obtaining Preliminary Site Plan Approval, the applicant must then satisfactorily address all Planning and Zoning Board stipulations before obtaining a Final Site Plan Approval. A Preliminary Site Plan Approval is not sufficient to obtain a building permit. (3) Final Site Plan Approval. A site plan will be given Final Site Plan Approval if and when the Planning and Zoning Board determines that the proiect, as designed, satisfies all of the requirements of the Code of Ordinances. After obtaining Final Site Plan Approval a building permit can be applied for. SECTION 2. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida,�d�and approval as provided by law.
