84-O-33ORDINANCE NO. 84-0- 33 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING ARTICLE R, SECTION 9.5-56 OF THE CODE OF ORDINANCES BY REDEFINING CERTAIN EXISTING EXEMPTIONS; DE- LETING CERTAIN EXEMPTIONS AND ADDING CERTAIN EXEMPTIONS; CONTAINING A REPEALER PROVISION; A SEVERABB.ITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board of the City of Edgewater, Florida, has reviewed Article 11, Section 9.5-56, Exemptions, of the Code of Ordinances of the City of Edgewater, Florida, at their meeting of October 31, 1984, and has recommended that certain amendments be made to Section 9.5-56 of the Code of Ordinances, and WHEREAS, the Edgewater City Council considered these recommendations at their November 5, 1984 Council meeting and authorized the City Attorney to draw up an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Article 11, Section 9.5-56, Exemptions, of the Code of Ordinances of the City of Edgewater, Florida, is hereby revised and amended as follows: (a) Single-family and duplex residences and accessory uses not to exceed two (2) units per lot; (a)•--€.�isring-beaa-fideagriezltural•{�ef setts; (b) Maintenance work on utility or transportation systems, if performed on established rights -of -way or easements; provided such maintenance work does not alter the purpose and intent of the system as constructed. (c) Bona fide agricultural pursuits including forestry except where an (e) (d) Maintenance work performed on existing mosquito control drainage canals for the purpose of public health and welfare; (e) Any existing development where they increase the footage up to 1,000 square feet of impervious surface or building space. (e) (f) The acceptance of a plat by the city council in accordance with the subdivision regulations, or approval of a site plan in accordancewitlir the zoning ordinance, shall be construed as a permit and a separate permit under this article is not required, but compliance herewith shall be demonstrated as a part of the review procedure pursuant to said Ordinances No. 880 or 79-0-7. Subsequent changes or additions not reflected by the accepted plat, or site plan, however, shall be subject to the terms of this article. (Ord. No. 80-0-66, §6, 8-25-80; Ord. SECTION 3. If any section, part of a section, paragraph, clause, phrase w word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
