84-O-30ORDINANCE NO. 84-0-30 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 19, ARTICLE 1, SEC. 19-1 AND SEC. 19-13 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY INCREASING THE SERVICE CHARGE FOR WATER AND SEWER SERVICES; PROVIDING THAT THE DEPOSIT AND BILL FOR UTILITY SERVICES SHALL BE IN THE PROPERTY OWNER'S NAME; PROVIDING FOR NO DEPOSIT REFUND CHECK FOR LESS THAN $1.00; REDUCING THE TIME FOR TERMINATION OF SERVICE FOR NON-PAYMENT OF BELL; PROVIDING THAT SERVICE WILL NOT BE DISCONTINUED FOR A DELINQUENT BILL OF LESS THAN $5.00; CONTAINING A REPEALER PROVISION; A SEVERABR.ITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, held a Special Meeting and Workshop on October 3, 1984, regarding meter deposits and changes to existing policies in the Utilities Department, and authorized the City Attorney to draw up an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Chapter 19, Article 1, Sec. 19-1 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended as follows: - Sec. 19-1. Utility deposit and service charge. The city shall require a utility deposit in the amount of thirty dollars ($30.00) plus a live-de44ar-{$3.00) ten dollar ($10.00) service charge before water or sewer service(s) are initiated to any equivalent living unit in the City. Such deposit shall be made by the Drooerty owner and the hill fir renter-ssreeeiving-wateF-eF-sewer-sewices. These monies shall be invested and the income derived therefrom be used in the operation of the water and sewer system thereby helping to keep the rates for said services to a minimum. No refund checks on deposits shall be issued for an amount less than one dollar 751 _nn7 SECTION 2. Chapter 19, Article 1, Sec. 19-13 of the Code of Ordinances of the City, of Edgewater, Florida, is hereby amended as follows:* Sec. 19-13. Payment of bills; service charge. Bills for the monthly charges and fees for water service and sewage disposal service shall be submitted and shall be payable upon receipt. A delinquency charge of ten (10) percent of the amount due for water and sewage disposal fees shall be charged against the customer by the city if the customer shall fail to pay the charges due for water service and sewage disposal fees within twenty(20) days of the billing date of said charges. Should there be a failure by the customer receiving water and sewage service to pay his bill in full for said service not later than f0F4y-five44Q thirty (30) days from the billing date for said service, then said service shall be terminated and shall not be reconnected after discontinuance until all past due water bills and sewer disposal fees are fully paid, together with said charge of ten (10) percent of past due bills and payment of a five-de}laF4$3.00) ten dollar ($10.00) service charge. The owner of each equivalent unit, regardless of whether the equivalent unit is rented or being occupied by the owner, shall be absolutely res- ponsible for the payment of all charges incurred to the equivalent living unit. No service will be discontinued for a delinquent bill of less than five dollars W.Vvl. Deleted items have been lined-thraugh and new language underscored. SECTION 3. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 5.
