84-O-29ORDINANCE NO. 84-0-29 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ESTABLISHING RULES AND REGULATIONS FOR THE USE OF AND CONDUCT IN CITY PARKS; PROVIDING FOR ENFORCEMENT OF SAID RULES AND REGULATIONS AND PROVIDING FOR A PENALTY FOR VIOLATION OF SAID RULES AND REGULATIONS; CONTAINING A REPEALER PROVISION; A SEVERABB.ITY CLAUSE; AND PRO- VIDING FOR AN EFFECTIVE DATE. WHEREAS, the Parks and Recreation Board has recommended Rules for City Parks at its August 8, 1984 regular meeting, and WHEREAS, the City Council of the City of Edgewater, Florida has considered these recommendations at their August 20, 1984 Council Meeting and has determined that certain rules for city parks shall be established for the protection of the public health, safety and welfare of the citizens of the City of Edgewater, Florida, and has authorized the City Attorney to draw up an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA- SECTION 1: That it shall be unlawful for any person in a City Park in the incorporated areas of the City of Edgewater, Florida, to: 1. Bring any animal, including cats, dogs, horses, any fowl or birds. and any living creatures within the jurisdiction of a City Park.or recreation area. 2. Bring alcoholic beverages, or controlled dangerous substances, drink or use the same at any time nor shall any person be under the influence of intoxicating liquor or a controlled dangerous substance in a City Park or recreation area. 3. Bring any glass container into a City Park or recreation area. 4. Expose or offer for sale any article in any City Park or recreation area without a license as a concessionaire or to display any advertising signs or other advertising matter without a permit. 5. Camp or stay overnight in a City Park or recreation area. 6. Build, kindle, maintain or use an open fire nor throw away or discard any lighted match, cigar, cigarette, tobacco, paper or other material until it is extinguished. *, cd 7. The City Police Department, RarkiA.ir //_y _gy �,yy ,, a park attendants shall, in connection with their dutie4'/mposed�w' by law, diligently enforce the provisions of this ordinance and shall have the authority to order any person or qq A /{j7�li�yi persons acting in violation of this ordinance to leave the park or recreation area. 1 Ml SECTION 3. Any person, firm or corporation violating any provision of this ordinance shall be fined not less than five dollars nor more than five hundred dollars for each offense, and a separate offense shall be deemed commited on each day during or on which a violation occurs or continues. SECTION 4. All ordinances, or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3. if any section, part of a section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 6. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida and approval as provided by law.
