FLORIDA, AMENDING ARTICLE 11, SECTION 7-21(Section 1302,5(g)(2) OF
THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA,
AUTHORIZING THE BUILDING OFFICIAL TO ENFORCE STRICT COM-
PLIANCE WITH ALL REQUIREMENTS TO PREVENT WATER RUNOFF

WHEREAS, it has been determined bytheCity Council of the City 11111

Florida, that the Building Official shall enforce strict compliance with all requirements

to prevent water runoff from flowing on to neighboring properties pursuant to Code li
requirements and to withhold the Certificate of Occupancy until all such requirements �-
have been met , and
WHEREAS, the City Council of the City of Edgewater, Florida, at their October
15, 1984 Council Meeting authorized the City Attorney to draw up an ordinance on the
subject;
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That Article 11, Section 7-21 (Section 1302.5(g)(2) of the Code of
Ordinances of the City of Edgewater, Florida, is hereby amended as follows:*
(2) With the exception of new structures which will be affected by the
higher elevation of surrounding structures within the confines of a
city block, or by elevation requirements imposed by the county
health department or by elevation requirements of the FIRM 100-
year floodplain data, then consideration shall be given by the board
upon recommendation of the building official as to keeping the
floor elevation in conformity with the surrounding area. The
building official shall have the authority to order proper berming, �'l1)9'

retention, swaling, grading or filling as required to ensure water �b7
runoff from the site, after construction, does not flow on to
neighboring properties. The building official shall, in connection with'/"��f
his duties imposed by law, diligently enforce the provisions of this IIM'
ordtnance and shall withhold the certificate
of occupancy until all provisions of this ordinanc have been met.f

SECTION 2. All ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict herewith be and the same are hereby repealed. Y j1-i4"

SECTION 3. If any section, part of a section, paragraph, clause, phrase, or word
of this ordinance is declared invalid, the remaining provisions of this ordinance shall
not be affected.
SECTION 4. This ordinance shall take effect immediately upon its adoption
by the City Council of the City of Edgewater, Florida, and approval as provided by law.
