84-O-10ORDINANCE NO. 84-0-10 AN ORDINANCE AMENDING CHAPTER 13, ARTICLE II, SECTION 13-21 OF THE EDGEWATER CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY REMOVING ALL DEPART- MENT HEADS FROM THE MERIT ORDINANCE; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, at a duly constituted regular meeting of June 18, 1984, elected to amend Chapter 13, Article II, Section 13-21 of the Edgewater Code of Ordinances by removing all Department Heads from the Merit Ordinance; NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: Section 1. That Chapter 13, Article It, Section 13-21 of the Edgewater Code of Ordinances is hereby amended as follows: "All offices and positions in the employ of the city shall be and hereby are allocated to the merit system excepting only those hereinafter specifically expempted. Those offices and positions specifically exempted are: All elected officials; all persons appointed to fill vacancies in elective offices; members of boards, commissions, and committees, serving with or without pay; the city attorney; the city auditor; the city manager; all department heads, temporary employees; and architects, auditors, consultants, counsel, engineers, and the like rendering temporary professional services under contract. Unless specifically designated otherwise, personnel policies and rules and regulations apply to all persons employed under the merit system." Section 2. That all ordinances, or parts of ordinances and all resolutions or parts of resolutions insofar as they are inconsistent or in conflict with the provisions of this ordinance, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. * Deleted items have been 44Red-thfeagh and new language underscored. - O O Section 4. That this ordinance shall take effect immediately upon its adoption by the City Council and approval as provided by law. This Ordinance was introduced by Councilman Wargo The first reading of the above ordinance was read in full, and passed by vote of the City Council of the City of Edgewater, Florida, at the regular meeting of said Council, held on the 16 day of July ,1984, and approved as provided by law. The second reading of this Ordinance to be at a regular meeting of the City Council of the City of Edgewater, Florida, to be held on the 6th day of August , 1994.
