84-O-5ORDINANCE NO. 84-0-5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING SECTION 42 OF THE CHARTER OF THE CITY OF EDGEWATER, BY CHANGING THE DESIGNATION FROM "FIRE FORCE; DUTIES" TO "EDGEWATER FIRE AND EMERGENCY RESCUE FORCE"; PRO- VIDING FOR SUPERVISION, DUTIES, AND DISCI- PLINE; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: Section 42 of the Charter of the City of Edgewater, Florida, is hereby amended as follows: Fire €ereet duties. Edgewater Fire and Emergency Rescue Force. The fire-€eree Edgewater Fire and Emergency Rescue Force e€-the-eity shall consist of a chief, who may be the chief of police, who shall be fire warden, and as many subordinate officers, firemen fighters, and employees and personnel as the city council shall, by resolution, determine. The fire chief shall have exclusive control of the stationing and transfer of all firemen fighters and other officers and employees of the €"re force subject to such rules and regulations as may be prescribed by the city council or by ordinances of the city; he shall have exclusive management and control of such officers and employees as may be employed in the administration of the affairs of his force. In case of riot, conflagration or like emer- gency, the mayor may appoint additional firemen fighters or officers for temporary service. Deleted items have been lined-t§reugh and new language has been underscored. The fire chief shall have the right to suspend any officer or employee of the €4�e force because of incompetency, neglect of duty, drunkenness, failure to obey orders given by proper authority or for any other just and reasonable cause, and he shall immediately report the fact of such suspension to the city council for final action. SECTION 2: All ordinances, or parts of ordinances, and all resolutions, or parts of resolutions, in conflict herewith be and the same are hereby repealed. SECTION 3: If any section, part of a section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4:. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
