84-O-1ORDINANCE NO. 94-04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA AMENDING "ARTICLE III CITIZEN CODE ENFORCEMENT BOARD" OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA BY: DELETING REFERENCES TO AN ALTERNATE MEMBER; INCREASING THE TIME FOR NOTICE OF SPECIAL MEETINGS FROM 24 TO 49 HOURS; AND PROVIDING THAT COPIES OF SECTION(S) ALLEGEDLY VIOLATAED AND THE BOARD PROCEDURES BE GIVEN TO ALL ALLEGED VIOLATORS WHEN THEY ARE NOTIFIED OF A HEARING; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA. SECTION 1. Section 2-50 of the Code of Ordinances of the City of Edgewater, Florida is hereby amended as follows: * Section 2-50(a) Organization; membership; standards of conduct; conflict of interest. (a) The City Council shall appoint a seven member Citizen Code Enforcement Board ar+a-atra9Aitiena!-al-tert+alr+nenrbeF- based upon the following standards and qualifications: Section 2-50(b) of the Code of Ordinances of the City of Edgewater, Florida is hereby amended as follows: - Section 2-50(b) Terms, initial appointments. Members shall be appointeed at staggered terms of three (3) years. The initial appointments shall be as follows: (1) Two (2) members and-thealteFnate-{ nber- shall be appointed for a term of one year. (2) Three (3) members shall be appointed for a term of two (2) years. (3) Two (2) members shall be appointed for a term of three (3) years. Section 2-50(e) of the Code of Ordinances of the City of Edgewater, Florida is. hereby amended as follows: * Section 2-50(e) Meetings. Meetings of the enforcement board shall occur no less frequently than once each month, but the enforcement board may meet more often as necessary. Special meetings of the board may be convened by the chairman or in his absence, the vice-chairman, upon giving notice thereof to each other member of the enforcement board, including-al{ernale. Notice of a special meeting shall be given at least twenty-fo -(2L4) forty-eight (48) hours prior thereto. SECTION 2. Section 2-53 of the Code of Ordinances of the City of Edgewater, Florida is hereby amended as follows * Section 2-53(e) Conduct of hearing. Before the board may proceed to hear a case, it must first determine that all interested parties have been properly noticed of the hearing. The alleged violator shall be notified of the hearing in writing and hand delivered by a city police officer. At such time, the alleged violator shall be given a copy of the ordinanEa-item-wHiEi�#+ii�artielederFver4andac�epY'vf-the Tales-and-regulations-ef-#ire�eard. section(s) of the ordinance of which he is allegedly in violation of and a copy of the procedures to be followed during the hearing before the board. -2- Ord. 84-0-1 U� 7 SECTION 3. All ordinances, or parts of ordinances and all resolutions, or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4. If any section, part of a section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 5. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida and approval as provided by law.
