AN EMERGENCY ORDINANCE ADOPTING CHAPTER 316,
FLORIDA STATUTES, STATE UNIFORM TRAFFIC CON-
TROL LAW, IN ITS ENTIRETY AS PART OF THE
EDGEWATER CODE OF ORDINANCES, OF THE CITY OF
EDGEWATER, FLORIDA; CONTAINING A REPEALER
PROVISION; A SEVERABILITY CLAUSE, PROVIDING
FOR AN EFFECTIVE DATE AND DISPENSING WITH
PUBLICATION AND THE REQUIREMENTS OF READING
SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT
LESS THAN TWO-THIRDS OF THE MEMBERS OF THE
CITY COUNCIL.
WHEREAS, it was the intent of the Florida Legislature in enacting
the Florida Uniform Traffic Control Law, Chapter 316 of the Florida
Statutes to have uniform traffic ordinances in all municipalities; and
WHEREAS, the City Council of the City of Edgewater? Florida finds
that it is in the best interest of the public health, safety and welfare
of the citizens of the City of Edgewater, Florida, that the provisions
of the Florida Uniform Traffic Control Law apply and be controlling
within the City Limits of the City of Edgewater, Florida for the purpose
of regulating traffic; and
WHEREAS, the City Council of the City of Edgewater, Florida wishes
to specifically adopt those provisions of the Florida Uniform Traffic
Control Law which are not classified as criminal violations as part of
the Code of Ordinances of the City of Edgewater, Florida in their entirety;
and
WHEREAS, it is the legislative intent of the City Council of the
City of Edgewater, Florida that a violation of this ordinance adopting
and incorporating the provisions of the Florida Uniform Traffic Control
Law, Chapter 316 of the Florida Statutes shall fall within the purview
of Section 901.25, Florida Statutes authorizing municipal police officers
to make fresh pursuit arrests outside the City Limits.
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
Section 1. That Florida Statutes Chapter 316, State uniform
Traffic Control Law, is hereby adopted, in its entirety, as if fully
set forth herein, as part of the Edgewater Code of Ordinances of the
City of Edgewater, Florida.
Section 2. That this ordinance is declared to be an emergency
ordinance and the requirements of publication and reading on two
separate dates are hereby waived.
Section 3. All ordinances, or parts of ordinances and all re-
solutions, or parts of resolutions, insofar as they are inconsistent
or in conflict with the provisions of.this ordinance, are hereby re-
pealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance, is declared invalid, the remaining
provisions of this ordinance shall not be affected.
Section 5. That this ordinance shall take effect immediately
upon its adoption by at least a two-thirds vote as an emergency
measure by the City Council.
The first reading of said Ordinance, as well as the second reading
of said Ordinance, was held at the regular meeting of the City Council
on the 18th day of July, 1983, and was adopted thereby.
