83-O-7ORDINANCE NO. 83-0-7 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, RELATING TO THE ADOPTION OF A CODE OF ETHICS FOR•MEMBERS OF THE CITY COUNCIL, ALL APPOINTED OFFICIALS AND EMPLOYEES OF THE CITY OF EDGEWATER, FLORIDA, AS ESTABLISHED BY PART III, CHAPTER 112, FLORIDA STATUTES (1981), AND PROVIDING FOR PRIOR ANNOUNCEMENT OF VOTING CONFLICTS, CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is in the interest of the public health, safety and welfare of the citizens of the city of Edgewater, Florida, to promote public confidence in the City government; to maintain conformity with the provisions and intent of the Charter; to provide guidance to the members of the City Council, and members of the Boards, Commissions and other officials appointed by the City Council concerning real or apparent conflict of interest, and WHEREAS, the provisions of this Ordinance are supple- mental to Part III, Chapter 112, Florida Statutes (1981), and other laws pertaining to conflict of interest and shall be interpreted in a manner consistent therewith, NOW THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: Section 1. The standard of conduct for members of the City Council, all appointed officials and employees of the City of Edgewater, Florida, shall be governed by Part III, Chapter 112, Florida Statutes (1981). Section 2. Voting Conflict: In addition to the compliance requirement contained in Section 112.3143, Florida Statutes, any member of the City Council or any appointed official voting in his official capacity �t C on any matter in which he has a personal, private or professional interest and which inure to his specific private gain, or the specific gain of any principal by whom he is retained shall announce the nature of his interest immediately prior to voting on said measure unless said elected or appointed official establishes that he neither knew; nor should have known after a reasonable inquiry that said voting conflict existed or was likely to exist, in order to announce his conflict prior to said voting. Said conflict, however, shall be disclosed at the next meeting adopting the minutes of the meeting in which the voting conflict took place. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared in- valid, the remaining provisions of this ordinance shall not be affected. Section 9. That all resolutions or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 5. That this ordinance shall take effect immediately upon its adoption by the City Council and approval as provided by law.
