85-O-20ORDINANCE NO. 85-0- 20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 17 OF THE CODE, OF ORDINANCES OF THE CITY OF EDGEWATER BY ADDING ARTICLE III, HANDICAPPED PARKING; PROVIDING REGULATIONS AND PENALTIES; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Florida in 1984 amended Florida Statute 316.008(4) granting municipalities power to enact an ordinance providing for a fine for the violation of disabled persons parking in excess of the fine specified by Florida Statute 318.18(2), but not to exceed One Hundred and no/100 ($100.00) Dollars, and WHEREAS, the Legislature of the State of Florida in 1985 by Session Law 85-325 increased the amount of said fine from One Hundred and no/100 ($100.00) Dollars to Two Hundred Fifty and no/100 ($250.00) Dollars, and WHEREAS, the City of Edgewater by Ordinance 83-0-13 adopted in its entirety Chapter 316, Florida Statutes, and WHEREAS, the City Council pursuant to Memorandum of July 23, 1985, from Lt. Britain directed the City Attorney at their regularly scheduled meeting of August 5, 1985, to prepare an Ordinance on the subject providing for a fine of. Seventy Five and no/100 ($75.00) Dollars per violation plus Five and no/100 ($5.00) Dollars Emergency Medical Trust Fund and Four and 50/100 ($4.50) Dollars, Law Enforcement Training Fund. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY -OF EDGEWATER, FLORIDA: SECTION 1. Chanter 17 of the Code of Ordinances of the City of Edgewater is hereby amended by adding Article III to read as follows:* Article III.' Handicapped Parking. Sec. 17-13. Parking regulations for disabled persons. *Deleted items have been lined-threhih and new language underscored. 4 Sec. 17-14. Penaltv. Violations of Section 17-13 shall constitute a civil infraction SECTION 2. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions shall not be affected. SECTION 4. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. -2- Ord.
