AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, AMENDING ARTICLE III. SEC-
TION 14-33 OF THE CODE OF ORDINANCES OF THE CITY
OF EDGEWATER BY REQUIRING THE CONCURRENT VOTE OF
FOUR (4) MEMBERS OF THE BOARD BEFORE ANY ACTION
IS TAKEN AND MAILING THE REVIEW OF SITE PLANS BY
THE BOARD SUBJECT TO FURTHER REVIEW BY THE CITY
COUNCIL; CONTAINING A REPEALER PROVISION; A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council at a regular meeting on
July 15, 1985, directed the City Attorney to prepare an
ordinance on the aforesaid amendments;
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF EDGEWATER, FLORIDA:
SECTION 1. Sec. 14-33. Organization; specific duties
and responsibilities enumerated of the Code of Ordinances
of the City of Edgewater, Florida, is hereby amended to read
as follows:*
(d) The board shall meet at regular intervals,
and at such other times as it may deem necessary,
for the transaction of its business. It shall
adopt written bylaws and keep a properly indexed
public record of its resolutions, transactions,
findings and recommendations. A quorum shall be
four (4) members. No recommendations for approval
of any application may be made unless three-{3}
four (4) members concur. The board shall make
rem reports on its business to the city
council.
(e) The board shall have all the duties and respon-
sibilities to them pertaining as a zoning com-
mission and local planning agency as set forth
and provided for under the constitution and laws
of the state and the charter, ordinances and
resolutions of the city and also the board shall:
(6) Subject to review by the CnCouncil, re-
rattachioiview, approve, oions or
approval of all site plans required to be
approved pursuant to section 715.02 of the
Edgewater Zoning Code or other applicable
requirements of the zoning ordinance, land
development regulations or comprehensive
plan.
SECTION 2. All ordinances or parts of ordinances and
all resolutions or parts of resolutions in conflict herewith
be and the same are hereby repealed.

SECTION 2. If any section, part of a section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
SECTION 3. This ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.
