85-O-13ORDINANCE NO. 85-0-13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 5, ANIMALS AND FOWL, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER BY ALLOWING FOR THE CAPTURE AND IMPOUNDMENT OF ANY ANIMAL RUNNING AT LARGE; CONTAINING A REPEALER PROVISION; A SEVERABB.ITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in order to protect the health, safety and welfare of the citizens of the City of Edgewater, the City Council, in response to a request from the Animal Control Officer, determined at their regular meeting of June 17, 1985, that specific authority should be designated for the capture and impoundment of any animal running at large when a health, nuisance or other problem arises which constitutes a threat to the health, safety and welfare of the citizens of the City of Edgewater, and WHEREAS, the Edgewater City Council has instructed the City Attorney to prepare an Ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Chapter 5, Section 5-5, Definitions, of the Code of Ordinances of the City of Edgewater, Florida, is hereby revised and amended as follows:* Sec. 5-5. Definitions. Capture. Capture shall mean the securing, restraining, immob- ilization or confinement of any animal at large by the use of cages, ropes, nets, tranquilizers or any other similar device which would tend not to permanently injure the animal. SECTION 2. That Chapter 5, Section 5-6, Running at large prohibited, of the Code of Ordinances of the City of Edgewater, Florida, is hereby revised and amended as follows:* Sec. 5-6. Running at large prohibited. No animal, whether licensed or unlicensed, exeept-eats, shall be at large. Any animal found at large shall be deemed to be committing an act in violation of this chapter. Any animals, at large captured by the Animal Control Officer shall be impounded and redeemed or disposed of as pro- vided' for in Sections 5-I8 and 5-19 of this Chapter. SECTION 3. That Chapter 5, Section 5-16, Impoundment, of the Code of Ordinances of the City of Edgewater, Florida, is hereby revised and amended as follows:* * Deleted items have been -}'fled -through -and new language underscored. Sec. 5-16. Impoundment. (c) Any animal running at large. SECTION 4. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 5. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions shall not be affected. SECTION 6.
