85-O-8J ORDINANCE NO. 85-0-8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, R,5,P FLORIDA, PERMITTING AND REGULATING THE USE OF DISH TYPE SATELLITE SIGNAL RECEIVING STATIONS; PROVIDING THAT STATIONS BE GROUND OR ROOF MOUNTED AND INSTALLED BY A$'^�w,can Qoat.gp�n� ,p �LferepfeS ". TECHNICIAN; PROVIDING THERE BE NOT MORE THAN ONE STATION PER RESIDENTIAL BUILDING OR CONDOMINIUM ASSOCIATION; PROVIDING 0 -y�,�C✓ THAT STATIONS SHALL NOT BE LINKED TO RECEIVERS WHICH ARE NOT U LOCATED ON THE SAME LOT AS THE STATION; PROVIDING THAT STATIONS WHEN ROOF MOUNTED OR ON TOWERS AND SIMILAR FORMS OF STRUCT- URAL SUPPORT SHALL BE SUBJECT TO ALL STRUCTURAL REQUIREMENTS OF THE BUILDING AND ELECTRICAL CODE; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board of the City of Edgewater, Florida, at their March 19, 1985 regularly scheduled meeting, has recommended the adoption of an ordinance pertaining to satellite signal receiving stations, and WHEREAS, the City Council of the City of Edgewater considered this recom- mendation at their April 1, 1985 Regular Council Meeting and is aware of the avail- ability for residential use of dish type satellite signal receiving stations, and WHEREAS, it is the desire of the City Council to both permit reasonable use by property owners of their property and to protect the rights of other property owners, and WHEREAS, the City Council is aware of its duty to protect the health, safety and welfare of the citizens of the City, and WHEREAS, the City Council has determined that it will not prohibit the use of such receiving stations, but will permit their use subject to reasonable regulation and has instructed the City Attorney to prepare an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: Dish Type Satellite Signal Receiving Stations, hereafter "Stations" shall be located in the "Yard, rear" or "Yard, side", as defined in the Code of Ordinances of the City of Edgewater, Florida. SECTION 2: The Stations shall be located so that however turned or otherwise used, all parts of the Station will be set back at least five (5) feet from the inner side yard nes and from the rear yard lot line. •� 5. r SECTION 3: That Stations may be ground or roof mounted and shall be V� instal d by a-Fisensed•+:V: Technician. SECTION 4: That there shall be not more than one Station per residential building or condominium association. SECTION 5: That Stations shall not be linked to receivers which are not located on the same lot as the Station. -1- SECTION 6: That Stations when roof mounted or on towers and similar forms of structural support shall be subject to all structural requirements of the Building and Electrical Codes. SECTION 7: All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 8: If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 9: This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approved as provided by law.
