ORDINANCE NO. 85-0-7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING ARTICLE VI, SOLID WASTE DISPOSAL, SECTION 19-65, OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, BY PROVIDING THAT REFUSE CONSISTING OF BROKEN GLASS SHALL BE PLACED IN A SEPARATE CONTAINER MARKED TO INDICATE THE CONTENTS THEREOF; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in order to protect the health, welfare and safety of the citizens of the City of Edgewater, the City Council determined at their regular meeting of March 18, 1985 that refuse consisting of broken or shattered glass should be placed in a container separate from garbage and trash containers and that container should be legibly labled to indicate the contents thereof; and WHEREAS, the Edgewater City Council has instructed the City Attorney to prepare an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Article VI, Section 19-65 of the Code of Ordinances of the City of Edgewater is hereby revised and amended as follows:* Sec. 19-65. Wrapping and preparation of garbage; keeping covered. All wet garbage matter shall be wrapped in paper before being placed in garbage cans. Tin cans, bottles and other containers shall be first drained of all liquids prior to being placed in garbage cans. All broken or shattered glass shall be placed in a separate container from other gar a e and trash and said container shall be legibly marked indicatin that the contents thereofare hazardous and should be handled With caution. All garbage cans shall be kept tightly'ed at all times except when it becomes necessary to lift the covers for the purpose of depositing garbage in the garbage can or for the purpose of emptying such can in a garbage truck. SECTION 2. A penalty for failure to comply with the provisions of this ordinance shall be imposed pursuant to Chapter 1, Section 1-8 of the Code of Ordinances of the City of Edgewater, Florida. * Deleted items have been#ned-threngk and new language underscored. -1- ?" O O SECTION 3. All ordinances or Parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 4. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 5. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. This ordinance was introduced by�At�.
