AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, PROVIDING FOR GARAGE SALES;
DEFINING GARAGE SALES; ESTABLISHING PERMITS, FEES,
T.ICENSING AND INFORMATION PROCEDURES; EXCEPTIONS
THERETO;AND PROVIDING A PENALTY FOR VIOLATION OF
THE TERMS AND REGULATIONS OF THIS ORDINANCE; CON-
TAINING A REPEALER PROVISION; A SEVF.RABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, at
their regular meeting of March 18, 1985, determined that it
was in the best interests of the citizens of the City of
.Edgewater that regulations be established to provide for
garage sales within the City of Edgewater, and
WHEREAS, the City Council of the City of Edgewater has
instructed the City Attorney to prepare an ordinance on the
subject;
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF EDGEWATER, FLORIDA:
SECTION 1. Definitions. (a) Garage sales shall mean and
include all sales entitled "garage sale", "Lawn sale", "attic
sale", "rummage sale", "flea market sale", "patio sale", "yard
sale", or any casual sale of tangible personal property which is
advertised by any means whereby the public at large is or can be
made aware of said sale.
(b) Goods are meant to include any goods, personal
property, warehouse merchandise or other property capable of
being the object of a sale regulated hereunder.
(c) Person shall mean and include individuals, partner-
ships, voluntary associations and corporations.
SECTION 2. Permits and Fees. It shall be unlawful for
any person to conduct a garage sale in the City without first
filing with the Clerk the information hereinafter specified and
obtaining from such Clerk a license to do so, to be known as
a "Garage Sale License". The fee for such license shall be
Two Dollars ($2.00).

SECTION 3. Licensing. Such license shall be issued to any
one person only two times within a twelve-month period and no
such license shall be issued for more than Two (2) consecutive
calendar days. Each license issued under this ordinance must
be prominently displayed on the premises upon which the garage
sale is conducted throughout the entire period of the licensed
sale.
SECTION 4. Information to be Filed. The information to
be filed with the Clerk, pursuant to this ordinance, shall be
as follows:
(a) Name of person, firm, group, corporation, assoc-
iation or organization conductinq said sale.
(b) Name of owner of the property on which said sale
is to be conducted, and consent of owner if applicant is other
than the owner.
(c) Location at which sale is to be conducted.
(d) Number of days of sale. ( 1 or 2)
(e) Date, nature of any past sale.
(f) Relationship or connection applicant may have had
with any other person, firm, group, organization, association or
corporation conducting said sale and the date or dates of such
sale.
(g) whether or not applicant has been issued any
other vendor's license by any local, state or federal agency.
(h) Sworn statement or affirmation by the person
signing that the information therein given is full and true and
known to him to be so.
SECTION 5. Persons and Sale Excepted. The provisions of
this ordinance shall not apply to or affect the following persons
or sales:
(a) Persons selling goods pursuant to an order or
Process of a court of competent jurisdiction.
(b) Persons acting in accordance with their powers
and duties as public officials.
(c) Any person selling or advertising for sale an
item or items of personal property which are specifically named
or described in the advertisement and which separate items do

not exceed five in number.
SECTION 6. Parking. Parking shall be controlled by the
person obtaining the license to prevent congestion and hazardous
conditions on adjacent streets.
SECTION 7. Signs. Signs will be permitted only on the
property for which the license is issued.
SECTION 8. Penalty. Any person, association or corporation
conducting any such sale without being properly licensed therefor
or who shall violate any of the other terms and regulations of
this ordinance, shall, upon conviction, be subject to fines
and penalties pursuant to Chapter 1, Section 108 of the Code
of Ordinances of the City of Edgewater, Florida.
SECTION 9. All ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith be
and the same are hereby repealed.
SECTION 10. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
SECTION 11. This ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.
