85-O-3ORDINANCE NO. 85-0-3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, REDESIGNATING A SIX (6) FOOT WIDE BUFFER STRIP IN FLORIDA SHORES ALONG 35TH STREET FROM ITS PRESENT USE AS A PLANTING BUFFER STRIP TO A RIGHT-OF-WAY; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Doris E. Massey, Realtor of the City of Edgewater, has requested by a letter dated November 27, 1984 to the City of Edgewater, that the City of Edgewater approve vacating a six (6) foot buffer strip for planting purposes and dedicate this strip for street purposes so as to give access to Block 2 Washington Park, Part VI, Map Book 11, Page 73, PubLic Records of Volusia County, Florida, and WHEREAS, the City Council of the City of Edgewater, Florida, at a regularly scheduled meeting of January 7, 1985, considered this request and by a vote of 5-0 directed the City Attorney to prepare an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the above -referenced property, more parti- cularly described as follows: A six (6) foot planting area located on Park Street from Needle Palm Drive to the West line of Lots 1 and 15 of Block 2, Florida Shores, being a distance of approximately 1,322.22 feet, as shown in Exhibit A attached hereto and by reference incorporated herein; be redesignated from its present use as a planting buffer strip to a right-of-way for street purposes. SECTION 2. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. -1- This ordinance was introduced by (pliwifGrTd� /�/r��.
