86-O-33ORDINANCE NO. 86-0-33 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING CHAPTER 11, OCCUPATIONAL LICENSES, TAXES AND REGULATIONS, SECTION 11-3, BY IMPOSING A TEN PERCENT PENALTY FEE FOR THE FIRST MONTH OF DELINQUENCY AND A FIVE PERCENT PENALTY FEE FOR EVERY SUBSEQUENT MONTH, NOT TO EXCEED A TOTAL 25 PERCENT PENALTY OF THE AMOUNT OWED, Q)NTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board of the City of Edgewater, Florida, at their regular meeting of August 21, 1986, recommended amendments regarding license penalty fees, and WHEREAS, the City Council of the City of Edgewater, Florida, at their regular meeting of September 15, 1996, considered this recommendation and directed the City Attorney to prepare an Ordinance on the subject; NOW, THEREFORE,BE ITENACTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Chapter 11, Occupational Licenses, Taxes and Re- gulations, Section 11-3, Term of license; proration of tax; delinquency charges, of the Code of Ordinances of the City of Edgewater, Florida, be amended as follows:* Section I1-3 Term of license; proration of tax; delinquency charges. No license shall be issued for more than one year, and all licenses shall expire on September thirtieth of each yea7, except as other- wise provided by law. For each license obtained for any new business, occupation or profession after April first of each year, one-half of the applicable annual occupational license tax shall be paid. Licenses which are not renewed on or before the expiration date may be reinstated thereafter upon payment by the holder of the license of the applicable license tax plus a delinquency charge in the amount of ten (10%) percent of such tax for the first month of delinquency, five (5%) percent each month of additional delinquency, up to a maximum of twenty-five (25%) percent, or as otherwise authorized by statute. A new license shall not be issued to any person for the privilege of engaging in or managing the same business, profession or occupation except upon payment of all past due license taxes and delinquency charges applicable thereto. * Deleted language has been lined-tgreugh and new language underscored. Page I of 3 pages Ordinance No. 86-0-33 SECTION 2. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4. This Ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law. This Ordinance was introduced by Councilman Asting This Ordinance was read on first reading and passed by a vote of the City Council of the City of Edgewater, Florida, and approval as provided by law, at a regular meeting of said Council on the 6th day of October 1986. The second reading of this Ordinance to be at a regular meeting of the City Council of the City of Edgewater, Florida, to be held on the 20th day of October , 1986.
