86-O-29ORDINANCE NO. WO-29 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, CHANGING THE ZONING CLASSIFICATION OF A PORTION OF U.S. LOT 7, SECTION 2, TOWNSHIP 18 SOUTH, RANGE 34 EAST, LYING EASTERLY OF AND ADJACENT TO U.S. HIGHWAY NO. 1, WITHIN THE CITY LIMITS OF THE CITY OF EDGEWATER, FROM ITS PRESENT ZONING CLASSIFICATION OF R4 TO B-3, PROVIDING THAT THE OFFICIAL ZONING MAP OF THE CITY OF EDGEWATER, FLORIDA, SHALL BE AMENDED TO REFLECT THIS CHANGE IN ZONING; CONTAINING A RE- PEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, She Chung Fong and Poo Jon Wong Fong are the owners of a piece of property, more particularly described in Appendix A, attached hereto and made a part hereof and by reference incorporated herein with full force and effectas if herein set forth, and as such owners have requested a change in the zoning of said property, and WHEREAS, the Planning and Zoning Board of the City of Edgewater, Florida, at a rergularly scheduled meeting of June 5, 1986, considered the re- zoning request and made a favorable recommendation to the City Council of the City of Edgewater, Florida, and WHEREAS, the City Council of the City of Edgewater, Florida, at a regularly scheduled meeting of July 21, 1986, considered said rezoning re- quest and recommendations from the Planning and Zoning Board and directed the City Attorney to prepare an Ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the property described in Appendix A, attached hereto and made a part herof and by reference incorporated herein with full force and effect as if herein set forth, is hereby rezoned from its present classification of R-1 to B-3.. SECTION 2. That no amendment shall be adopted until after public notice and Hearing in accordance with Section 1103.00 of the Code of Ordinances of the City of Edgewater, Florida. SECTION 3. That the appropriate City Officials are hereby directed in accordance with Section 2 above to change the official zoning map to conform with said rezoning. SECTION 4. That the City Clerk of the City of Edgewater, Florida, is hereby directed to comply with the necessary Hearing and Publication require- ments for adoption of this ordinance. SECTION 5. All ordinances or parts of ordiannces and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed, as well as any portion of the Official Zoning Map of the City of Edgewater, Florida, in conflict herewith SECTION 6. If anysection, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 7. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
