AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA, AMENDING
CHAPTER 12, OFFENSES AND MISCEL•LANEOUS
PROVISIONS, OF THE CODE OF ORDINANCES OF
THE CITY OF EDGEWATER, FLORIDA, BY
CREATING A NEW SECTION 12.4, ENTITLED
"DISCHARGE OF FIREARMS, WEAPONS," BY
CONTROLLING THE USE OF FIREARMS AND
WEAPONS; CONTAINING A REPEALER PROVISION,
A SEVERABILITY CLAUSE, AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, it has been determined that in order to
promote and protect the health and safety and welfare of

the public, it is necessary to regulate the possession of
firearms and other dangerous weapons, and
WHEREAS, the corporate authorities of the City
of Edgewater, have found and determined that the easy and
convenient availability of certain types of firearms and
weapons have increased the potentiality of firearm related
deaths and injuries,
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE
CITY OF EDGEWATER, FLORIDA:
SECTION 1. Section 12-4 of Chapter 12 of the Code
of Ordinances of the City of Edgewater, Florida, be and is
hereby created to read as follows:
Section 12-4 Discharge of Firearms, Weapons
(a) It shall be unlawful to discharge any firearm
or airgun, B.B. gun, or any toy gun, projecting lead or any
missiles excepting in a regularly established shooting
gallery; provided that this section shall not be construed
to prohibit any officer of the law from discharging a fire-
arm in the performance of his duty; nor to any citizen from
discharging a firearm when lawfully defending person or.
property.
(b) It shall be unlawful to carry any concealed
weapons in the city in violation of the laws of this State.
(c) Killing and Injuring Animals
It shall be unlawful for any person knowlingly to
discharge any firearm, B.B. gun, air or gas operated guns,
darts, arrows or slingshots upon dogs, cats, birds, squirrels
or any other animal, with the intention of killing, injuring
or inflicting pain on such animals, within the city limits.
SECTION 2. All ordinances.or parts of ordinances
and all resolutions or parts of resolutions in conflict
herewith be and the same are hereby repealed.
SECTION 3. If any section, part of a section,
paragraph, clause, phrase or word of this ordinance is de-
clared invalid, the remaining provisions of this ordinance
shall not be affected.
SECTION 4. This ordinance shall take effect
immediately upon its adoption by the City Council of the
City of Edgewater, Florida, and approval as provided by law.
This ordinance was introduced by Councilman
Asting
Thisordinance was read on first reading and passed
by a vote of the City Councilof the City of Edgewater,
Florida, and approval as provided by law, at its regular
meeting on the 4th day of August , 1986.
The second reading of this ordinance to be at a
regular meeting of the City Council of the City of
Edgewater, Florida, to be held on the 15th day of
September , 1986.
