RAILROAD TRACKS FROM 'I= to 30th STREETS; BY ALLOWING AUTOMOBILE SALES IN THE SAME DISTRICT• BY ALLOWING THE RETAIL SALE OF GASOLINE AT CONVEN- IENCER ES AS A SPECIAL EXCEPTION IN THE B-2 DISTRICT; BY ALLOWING CONVENIENCE FOOD STORES AND THE SALE OF GASOLINE IN THE B-3 DISTRICT AS A PERMITTED USE; BY ALLOWING AUTO SER- VICE TYPES A AND B AS A PERMITTED USE IN THE B-5 DISTRICT: BY INTRODUCING AUTOMOTIVE SERVICE IN THE LICENSE TAX SCHEDULE; BY DELETING SERVICE STATIONS AND.ADDING AUTOMOTIVE SERVICES THROUGHOUT SECTION 713 OF THE CODE; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECT- IVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Appendix A, Article II, Sec. 200.00 of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* ARTICLE 11. DEFINITIONS Sec. 200.00. Interpretations of certain terms and words. Auto Paint and Body Shops - General repair, rebuilding or reconditioning of engines, motor vehicles or trailers; Convenience Food Stores - Sh000lne eoods and articles that are burchased y with a minimum of effort for immediate use. Appendix A, Article VI, Sec. 606.01, B-2 Neighborhood Business District, of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* (b) Permitted uses: Auto Paint and Body Shops - To be allowed in that area of land along Florida East Coast railroad tracks from i to 30th Streets in the city. Convenience Food Stores in conjunction with retail sales of gasoline is included as a Special Exception in the B-2 district. All requirements of Sec. 713.00 shall be complied with. No mechanical or body repairs or the sale of motor vehicles is allowed. Appendix A, Article VI, Sec. 607.00, 1-1, Light Industrial District, of the Code of Ordinances of the City of Edgewater is hereby amended as follows:' (b) Permitted uses: Auto Paint and Body Shops. SECTION 7. Appendix A, Article V11, Sec. 713.00 of the Code of Ordinances of the City of Edgewater is hereby amended as follows:' Sec. 713.00 SeFviee-StatieRs Automotive Services Sec. 713.01. No public street, parking, sidewalk or alley shall be used for the storage or parking of motor vehicles in connection with the activities of Type A and B asd-C--sefviee-staliene- automotive services, except for normal permitted parking by individuals, private owners or operators of such vehicles. -2- Ord. No. 96-0-3 Sec. 713.02. No operation in connection with Type A and B and-C- seFviee-statiens automotive services shall be conducted in a manner which impedes free flow of vehicular or pedestrian traffic using public ways. Sec. 713.03 All motor vehicles being handled, stored or repaired by Type A or B, eF-6--- seFviee-statiens- automotive services or in connection with such operations shall be maintained in such condition that they may be moved under their own power at any time, except such vehicles may be stored or under repair in garage or other buildings as provided below. Sec. 713.06. A Type A or B eF-6—seevtee-staFien automotive services lot shall not be less than one hundred (100) feet in width and eight thousand (8,000) square feet in area. Sec. 713.07. There shall be a minimum distance of seven hundred fifty (750) feet between the nearest points on any two lots occupied or to be occupied for Type AT or B eF-E--seFv4ee-sta4ens automotive services. This requirement shall not apply in B-3, Highway Commercial districts. Sec. 713.10. A buffer shall be installed along all property lines other than the street right-of-way lines, around Type AT and B andC-seFviee-s£atiens- automotive services according to Article 11. SECTION 8. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 9. If any section, partof a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 10. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
