86-O-24 � � 28O61931 ORDINANCE NO. 86-0-2 BOOK PAGE VOLUSIA 'OUNTY FLO'l,; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, VACATING ALL OF THAT PART OF ALVAREZ LANE WEST OF HUBBELL STREET IN THE EDGEWATER HIGHLANDS SUBDIVISION, CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, at a regularly scheduled Council Meeting of February 3, 1986, adopted a resolution declaring its intention to vacate the subject Property, described as follows: All of that part of Alvarez Lane, West Of Hubbell Street, in,the Edgewater Highlands Subdivision, as shownonplat of Edgewater Highlands Subdivision, per Map Book 7, page 107 of the Public Records of Volusia County, Florida. and, WHEREAS, the Public Works Superintendent, the Building Official and the Police Chief of the City of Edgewater, have de- clared the subject property to be of no use and not needed ny the City of Edgewater, and WHEREAS, the the right-of-way of any lot owner is not hereby impaired; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That all of that part of Alvarez Lane, West of Hubbell Street, in the Edgewater Highlands Subdivision is hereby vacated and released by the City Council of the City of Edgewater, Florida. SECTION 2. That all right, title and interest held by the City of:'Edgewater, Florida, is hereby released, pursuant to law, to the grantor or grantors, or successors in title, owning adjoining land to said property. SECTION 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith here- with be and the same are hereby repealed. SECTION 5. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 6. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
