ORDINANCE NO. 87-0-29
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, CALLING FOR A SPECIAL ELECTION FOR
THE PURPOSE OF AMENDING THE CITY CHARTER BY PROVIDING
FOR A CITY MANAGER TO BE APPOINTED BY THE COUNCIL BY
ORDINANCE; BY PROVIDING FOR BIENNIAL CITY MANAGER VOTER
PERFORMANCE APPROVAL; AND BY PROVIDING FOR RESIDENCY
REQUIREMENTS FOR THE CITY MANAGER AND DEPARTMENT HEADS;

WHEREAS, a Petition signed by 817 registered voters of the A e cLpVA
L ietrK
City of Edgewater, was presented to the City Council of the City
of Edgewater, Florida on the 19th day of October, 1987, and
WHEREAS, on October 22, 1987, the Supervisor of Elections,
in and for Volusia County, Florida, has certified that the 707
signatures appearing in said Petition are registered voters,
whose signatures compare with those on the voting registration
records in and for the City of Edgewater, Florida, and
WHEREAS, Chapter 166.031, Florida Statutes, gives the City
Council of the City of Edgewater, the authority and power
pursuant to a petition signed by more than ten (10%) percent of
the registered voters of the municipality, to call for a special
referendum election to submit a proposed Charter Amendment to the
electors of the City of Edgewater, and
WHEREAS, the Petition was accepted as certified by the
City Council of the City of Edgewater at a regular meeting held
on November 2, 1987, and
WHEREAS, the City Council has therefore decided to hold a
special election.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. The City Council of the City of Edgewater,
Florida, hereby submits the following amendment for submission to
the qualified electors of the City of Edgewater, F44lorida, at a
special election on FE6RdpR`C Z-X 198$. 69�_ Zp 70.

SECTION 2. That the questions to appear on the ballot
shall read as follows:
1. Should the City Charter be amended giving the Council
the authority to appoint by Ordinance a City Manager and
providing for duties, responsibilities and conditions of employment?
2. Should the City Manager be subject to a voters
performance approval every two years?
3. Should the City Manager and Department Heads reside
within the city limits of the City of Edgewater.
SECTION 3. The proper officials are hereby instructed and
directed to take all actions necessary for the submission of this
proposed Charter Amendment to the electors of the City of
Edgewater, by placing it on the ballot in substantially the
following form:

SECTION 4. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.

SECTION 5. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.,
SECTION 6. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.
This Ordinance was introduced by Councilman Mitchum
This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a regular meeting of
said Council held on the 7th day of December 1987.
The second reading of this Ordinance to be at a regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 21stday of December , 1987.
