87-O-25ORDINANCE NO. 87-0-25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ESTABLISHING A POLICY FOR DIS- HONORED CHECKS, PROVIDING FOR COLLECTION OF A FEE UP TO TWENTY-FIVE ($25.00) DOLLARS; PROVIDING FOR WARNINGS, AND PENALTIES FOR DISHONORED CHECKS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the cost generated by dishonored checks should be assessed to the responsible party, otherwise it will be an increase of the operation of the utility that will eventually be charged to the rest of the consumers. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the following penalties shall be imposed for dishonored checks, drafts or other payment of money in accordance with Florida Statute 166.251: a. There shall be collected as a service fee for the collection of the first dishonored check, draft or other order, for the payment of money to an official or agency of the City of Edgewater, the sum of Ten ($10.00) Dollars or five (58) percent of the face amount of the check, draft or order, whichever is greater, up to a maximum fee of Twenty-five ($25.00) Dollars. This service fee shall be in addition to all other penalties imposed by law. In addition, a written warning will be issued by registered mail to the consumer, giving notice that in the event a second dishonored check is received, the account will be marked "Do Not Accept Personal Checks." b. There shall be collected as a service fee for the collection of a second dishonored check, draft or other order, by the same customer, for the payment of money to an official or agency of the City of Edgewater, the sum of Ten ($10.00) Dollars or five (58) percent of the face amount of the check, draft or order, whichever is greater, up to a maximum of Twenty-five ($25.00) Dollars and the account will be marked "Do Not Accept Personal Checks" and the necessary steps taken for collection of said dishonored check. SECTION 2. In the event that the Bank that returned the check should not have done so, then the consumer is informed to 1 87-0-25 bring a letter from the Bank stating they made an error and they should not have returned the check. Then the indication on the consumer's account "Do not accept Personal Checks" will be deleted from said consumer's account, and personal checks will again be accepted in payment of said consumer's account. SECTION 3. All consumers opening up new accounts shall be advised of the foregoing penalties. All existing consumers will be forwarded a copy of the foregoing penalties with their next water bill. SECTION 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed. SECTION 5. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 6. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
