87-O-15ORDINANCE NO. 87-0-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA AMENDING APPENDIX A, ARTICLE VI, SECTION 605.02 "MOBILE HOME SUBDIVISION DISTRICT" OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, BY REPLACING ALL REFERENCES OF MOBILE HOME WITH MANUFACTURED HOME; BY ALLOWING POOLS AND OTHER RECREATIONAL FACILITIES; BY INCREASING THE MINIMUM SIZE FROM 10 TO 50 ACRES; BY INCREASING THE LOT AREA, THE DIMENSIONAL REQUIREMENTS, THE LIVING AREA REQUIREMENTS) REGULATING SIGNS, TREE REMOVAL AND OPEN SPACES; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board of the City of Edgewater, Florida, at a regular meeting of December 18, 1986, recommended that an amendment be made to Section 605.02, MH-2, Mobile Home Subdivision District; and WHEREAS, the City Council of the City of Edgewater, at a regular scheduled meeting of January 5, 1987, instructed the City Attorney to prepare an ordinance on the subject; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Appendix A, Article VI, Sec. 605.02, Mobile Home Subdivision District, of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* APPENDIX A, ARTICLE VI, SEC. 605.02 McBIBB MANUFACTURED HOME SUBDIVISION DISTRICT Sec. 605.02. MH-2Mebiie Manufactured Home Subdivision District. (a) Statement of Intent: The MH-2 Mebile Manufactured Home Subdivision District is intended to apply to areas to be used for mobile manufactured home subdivisions. All land areas which were platted and recorded subdivisions prior to the areas rezoning as an MH-2 District must only comply with the regulations listed below prior to the sale of any lots for the placement of a mebile manufactured home. Any area that is zoned as an MH-2 District and will be a newly platted and recorded mobile manufactured home subdivision must comply with the MH-2 District regulations and the requirements of the city's subdivision ordinance (App. B of Code) prior to the sale of any lots for the placement of a mobile manufactured home. (b) Permitted uses: Mobile Manufactured home subdivisions for the placement of a mobile manufactured home on individually owned lots, public or private parks, playgrounds, playfields, recreation buildings, clubs and facilities owned and operated by federal, state, county or municipal governments. (c) Permitted accessory uses: Awnings, cabanas, utility sheds, carports, windbreaks, porches, pools, or other recreation facility, or similar type uses. Ail aeeessery uses and struetures shall be eensidered to be part of the dwelling unit- (e) Dimensional requirements: ( 1 ) Minimum site size: Ten flea Fifty (50) acres, excluding wetlands. (2) Minimum lot size: Lot area: 57Se9 Six thousand (6000) square feet, excluding wetlands bet width- 5e feet bet lengthy lie feet Side yard: Eight (8)feet Front yard: Twenty-five (25) feet from cartway Rear yard: Ten (10) feet Corner lot: Twenty-five (25) feet from cartway, both streets. (3) Minimum living area: Six hundred E69ei Nine hundred (900) square feet excluding accessory structures. (4) Maximum height: Twenty-five k251 Sixteen (16) feet from ground level. (f) Perimeter enclosure requirement: The perimeter of the area between the ground and floor level of the mobile manufactured home shall be enclosed with skirting or other screening technique to eliminate the view of the underside of the building from the street. (g) Off-street parking: Two (2) off-street parking spaces shall be provided for each mobile manufactured home. (h) Signs shall be prohibited in the MH-2 Mobile Home Subdivision Bistriet- Signs shall be permitted throughout a 2 Ord. 87-0-15 shall be provided for each mebile manufactured home. (h) Signs shall be prohibited in the MH-2 Mobile Home Subdivision Bistriet- Signs shall be permitted throughout a manufactured home development, provided all such signs are of a coordinated graphic style including entry signs, directional and traffic signs sales model signs, street signs and house numbering signs and other similar signs. HOUSE FOR SALE signs shall be permitted providing such signs are displayed only in a window of the housing unit for sale. All other signs are prohibited. (i) .Application for rezoning: (6) Approximate density of population and-�/ mebiiemanufactured homes. (8) Common open space - minimum of twenty (20%) percent. $,y, Prior to the issuance of 'ay��Ky�jK (j) Site plan requirement: building permit, tour E49 espies thirteen (13) copies of a site plan must be submitted to and approved by the Planning and Zoning Board for all MH-2 zoned land. The site plan shall be drawn at a scale no smaller than one (1) inch equals one hundred (100) feet tiu-iBB�3 shall be in substantial compliance with the outline development plan and shall show the following information: (k) Planning and Zoning Board review and approval: (2)Before acting on the plan the Zoning Board may request written reports from theeity Manager City Clerk/Administrator, City Council, County Health Department, Chief Building Official, Superintendent of Schools, and such other public officials or agencies. (1) Performance bond or improvements to be installed: (1) Prepare construction plans and specifications for all required improvements which shall meet with the approval of the eity Manager City Clerk/Administrator. After receiving written approval from the eity Manager City Clerk/Administrator a start -work notice shall be issued by the chief building official whereupon the subdivider is allowed to install all required improvements, including landfill in I performance bond acceptable to the City in the amount of One Hundred and Ten (110%) percent of the construction costs, including landfill as estimated by the eily Manager City_ Clerk/Administrator to guarantee the installation of the required improvements. If option one (1) is selected, no lots may be sold until all of the required improvements have been installed by the subdivider. The chief Building Official shall make periodic site inspections and file a written report with the eily Manager City Clerk/Administrator when the required improvements have been installed. (m) Occupancy permits: An occupancy permit shall be issued only after all improvements have been installed and each mebiie manufactured home has been connected into the utility system. (n) Tree removal: All MH-2 developments shall comply with Article IV, the "Tree Preservation and Protection Ordinance", of the City of Edgewater. SECTION 2. All ordinances or parts of ordinances and all resolutions in conflict herewith be and the same are hereby repealed. SECTION 3. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 4. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, and approval as provided by law.
