87-O-3ORDINANCE NO. 87-0-3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AMENDING ARTICLE II, SEC- TIONS 19-10, 19-12, 19-14, 19-42 AND 19-43 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, BY PROVIDING FOR THE ESTABLISHMENT OF A RAW WATER DISTRIBUTION SYSTEM OUTSIDE THE CITY; BY PROVIDING FOR CONNECTION CHARGES TO SAID SYSTEM; BY PROVIDING FOR METER RATES; BY PROVIDING FOR IMPACT FEES AND PAYMENT OF SAID FEES BEFORE CONNECTIONS TO SAID RAW WATER SYSTEM OUTSIDE THE CITY AND BY REESTABLISHING AND INCREASING THE POTABLE WATER CONNECTION CHARGES INSIDE THE CITY; CONTAINING A REPEALER PROVISION; A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE WHEREAS, after an extensive study which culminated in a report delivered to the City Council on December 4, 1986, the firm of Dyer, Riddle, Mills and Precourt, Inc. recommended that the City institute a raw water system with rates and charges to appropriately recover the costs of upgrading and expanding its water supply systems, and WHEREAS, the City Council accepted the above recommendation and directed that it be implemented; NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. Article II, Section 19-10, Equivalent resi- ential unit (E.R.U.), of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* (g) Potable water system. Includes two (2) broad cate- gories of subsystems which are: (h) Raw water system. Includes two (2) broad categories of subsystems which are: (1) Primary system: a. Wells and well pumps; b. Raw water mains. (2) Secondary or local distribution system: a. Services including metering; b. Six-inch and smaller raw water distribution piping. SECTION 2. Said charge shall be in an amount equal to the equiva- lent charge for a corresponding connection inside the city limits plus a twenty-five (25) percent surcharge as allowed by appli- cable state statutes. (c) The following connection charges shall be required for each connection made to the raw water systems outside the city limits: Meter Size Connection Charge (inches) (Raw) 5/8 x 3/4 $260.00 1 $330.00 1-1/2 $510.00 2 $700.00 3 $1,100.00 4 $1,620.00 6 $2,420.00 SECTION 3. Article II, Section 19-14, Meter rates - Minimum, of the Code of Ordinances of the City of Edgewater is -2- Ord. 87-0-3 hereby amended as follows:* Sec. 19-14. Meter rates - Minimum. The following meter rates shall be applied to all retail quantities of water as shown by monthly meter readings to have been delivered: (a) Potable water system. Fa}(1) Inside city limits. Eb3(2) ,Outside city limits.. (b) Raw water system outside city limits only. (1) Monthly Usage Rate (gallons) 2,000 gallons or less, minimum ..... $1.02 Excess of 2,000 gallons, per 1,000 gallons ....................... 0.13 Each monthly bill shall be rendered for an amount of not less than one dollar and two cents ($1.02) which shall allow the use of two thousand (2,000) gallons of water per month. SECTION 4. Article II, Section 19-42, Impact fee estab- lishment and fee schedule, of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* (q) For each equivalent residential unit connected to the system outside the city: Raw water service impact fee...................$240.00 SECTION 5. Article II, Section 19-43, Imposing fee; method of payment, of the Code of Ordinances of the City of Edgewater is hereby amended as follows:* (7) Raw water connection outside City limits. For each ERU constructed, a fee of Two Hundred Forty Dollars ($240.00) will be paid prior to connections. SECTION 5. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 6. If any section, part of a section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. SECTION 7. This ordinance shall take effect immediately upon its adoption by the City Council of the City of Edgewater, -3- Ord. 67-0-3 Florida, and approval as provided by law.
